<br />premises, as remodeled to meet the needs of the Division of
<br />Planning and Neighborhood Development, not to exceed Twenty
<br />Thousand Dollars ($20,000.00); and
<br />WHEREAS, the Board of Public Works also received, on August
<br />10, 1992, a certificate of the St. Joseph County Auditor,
<br />certifying that the verifier of the Petition and the signatories
<br />of the Petition are taxpayers of property located within the
<br />corporate limits of the City of South Bend; and
<br />WHEREAS, the'Board of Public Works also received, on August
<br />10, 1992, a proposed lease agreement ("Proposed Lease")
<br />concerning the lease of the Premises as petitioned; and
<br />WHEREAS, I.C. 36-1-10-7(2) requires, prior to the Board of
<br />Public Works entering into a lease agreement for said premises,
<br />that the South Bend Common Council, after investigation,
<br />determine that the premises are needed.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND, INDIANA, as follows:
<br />1. The Board of Public Works of the City of South Bend,
<br />Indiana, hereby expresses its desire and intent to lease office
<br />space at Suite 416, 205 West Jefferson Boulevard, South Bend,
<br />Indiana, for the use and benefit of the City of South Bend,
<br />Department of Economic Development, Division of Planning and
<br />Neighborhood Development.
<br />2. That remodeling of said Premises is necessary in order to
<br />convert said Premises into fully functioning, usable office space
<br />for the Division of Planning and Neighborhood Development.
<br />3. That the cost of remodeling the Premises is estimated to
<br />total Thirteen Thousand Seven Hundred Forty-three Dollars
<br />($13,743.00), which cost is to be included in and made a part of
<br />the annual rental of the Premises.
<br />4. That preliminary plans, specifications and estimates of
<br />the cost of the proposed renovations submitted to the Board of
<br />Public Works on August 10, 1992, are hereby accepted for filing
<br />and are made available for public inspection.
<br />5. That the Petition, as certified by the St. Joseph County
<br />Auditor, submitted to the Board of Public Works on August 10,
<br />1992, is hereby accepted for filing and made available for public
<br />inspection.
<br />6. That the lease of the Premises shall be for a period of
<br />three (3) years, with an annual rental not to exceed Twenty
<br />Thousand Dollars ($20,000.00).
<br />7. That the Proposed Lease for the Premises submitted to the
<br />Board of Public Works on August 10, 1992, is hereby accepted for
<br />filing and made available for public inspection.
<br />8. That the Board of Public Works directs and authorizes the
<br />Director of the Department of Economic Development of the City of
<br />South Bend as its agent, to file with the City Clerk for
<br />consideration by the Common Council of the City of South Bend,
<br />Indiana, a form of resolution to establish, after investigation,
<br />its determination that the lease of the Premises described herein
<br />is needed.
<br />9. That a public hearing on the Proposed Lease is set for
<br />the 31st day of August, 1992, at 9:30 a.m., in the Board of
<br />Public Works Meeting Room, 1308 County -City Building, South Bend,
<br />Indiana 46601, at which hearing all persons wishing to be heard
<br />will be given the chance to address whether the Proposed Lease is
<br />necessary and whether the proposed rental is fair and reasonable.
