REGULAR MEETING JUNE 8, 1992 bid was opened and publicly read-: MC INTYRE & JONES CONSTRUCTION COMPANY INC. 2526 West 6th Street Mishawaka, Indiana 46544 Bid was signed by Mr. Kenneth A. McIntyre, Chairman Of The Board, Non -Collusion Affidavit was in order, Non - Discrimination Commitment form was completed and a five per cent (5%) Bid Bond was submitted. BID: $76,125.00 Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the above bid was referred to the Engineering Department for review and recommendation. FAVORABLE RECOMMENDATION - VACATION OF EAST SORIN STREET/NEDDO COURT Mr. Leszczynski advised that submitted to the Board is the second amended Vacation Petition as filed by Mr. C. Brian Sauers, Esq., Barnes & Thornburg, 600 1st Source Bank Center, 100 North Michigan Street, South Bend, Indiana, on behalf of Madison Center, Inc., 403 East Madison, South Bend, Indiana, and Bert and Etta Liss Trust, Society Bank, Co -Trustee, to vacate the following property: East Sorin Street, from the west right-of-way line of North Niles Avenue, running West to the St. Joseph River, for a distance of approximately 330 feet; Neddo Court, from the north right-of-way line of East Sorin Street to a point approximately sixty-six feet (66') South of the North right-of-way of the first east -west alley North of East Sorin Street; and Neddo Court, from the North right- of-way line of the first east -west alley North of East Sorin Street to the South right-of-way line of the Second east -west alley North of East Sorin Street. It is noted that on May 4, 1992, the Board of Public Works tabled making a recommendation on a Vacation Petition as submitted by Mr. Sauers to close the following: East Sorin Street from the west right-of-way line of N. Niles Avenue to the St. Joseph River; the first and second east -west alleys south of vacated Hagerty Street, from the west right-of-way line of N. Niles Avenue, to the east right-of-way line of the first north -south alley west of N. Niles Avenue; and the first north -south alley west of N. Niles Avenue, from the north right-of-way line of E. Sorin Street to the north right-of-way line of the first east -west alley south of vacated Hagerty Street. Parts located in Coquillard's First Addition in the City of South Bend, Indiana. It is further noted that since this matter was tabled on May 4, 1992, the Vacation Petition has been amended to vacate only the property as first referenced above. Mr. Leszczynski informed members of the Board that the Engineering Department, Department of Economic Development, Area Plan Commission, Police Department and Fire Department have all submitted favorable recommendations concerning this second amended vacation. Assistant City Attorney Jenny Pitts Manier indicated that the Department of Economic Development has been working with Madison Center and recommend that the Board submit a favorable recommendation to the Common Council concerning this vacation with the understanding that Madison Center grant to the City a fourteen foot (14') Easement for a walkway across 1 1
