413 J <br />REGULAR MEETING <br />DECEMBER 6, 1993 <br />with another governmental entity upon terms and conditions agreed <br />upon by the two (2) entities as evidenced by the adoption of <br />substantially identical resolutions of each entity; and <br />WHEREAS, the Commission has agreed to transfer the Real <br />Property to the City of South Bend, and the City of South Bend, <br />acting by and through the Board, has agreed to accept the transfer <br />of the Real Property from the Commission for the payment of a. <br />nominal consideration. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND AS FOLLOWS: <br />1. That the transfer of the following described real <br />property situated in St. Joseph County, Indiana by the South Bend <br />Redevelopment Commission to the City of South Bend, acting by and <br />through its Board of Public Works: <br />A part of the Northeast Quarter of Section 28, Township 38 <br />North, Range 2 East, St. Joseph County, Indiana, described as <br />follows: Commencing at the Northeast corner of said section; <br />thence South 89 degrees 48 minutes 05 seconds West 966.00 <br />feet; thence South 0 degrees 00 minutes 23 seconds West 40.0 <br />feet to the point of beginning of this description; thence <br />South 0 degrees 00 minutes 23 seconds West 450.00 feet; <br />thence South 89 degrees 48 minutes 05 seconds West 275.88 <br />feet; thence Northwesterly 294.37 feet along an arc to the <br />right having a radius of 1,869.86 feet and subtended by a <br />chord having a bearing of North 4 degrees 30 minutes 13 <br />seconds West and a length of 294.07 feet; thence North 0 <br />degrees 00 minutes 23 seconds East 146.76 feet; thence North <br />44 degrees 54 minutes 14 seconds East 14.17 feet; thence <br />North 89 degrees 48 minutes 05 seconds East 289.00 feet to <br />the point of beginning and containing 3.036 acres, more or <br />less; (hereinafter referred to as the "Real Property"); <br />for the sum of One Dollar ($1.00), shall be, and hereby is, <br />approved. <br />2. That upon receipt of a fully executed quitclaim deed to <br />the Real Property from the Commission, the Clerk of the Board is <br />hereby authorized and directed to pay to the Commission, on behalf <br />of the Board, the sum of One Dollar ($1.00) and to cause the <br />recording of said quitclaim deed. <br />3. Mueller reminded members of the Board that <br />on October 11, 1993, an emergency three (3) month lease was <br />entered into with Tom Herrman & Associates, 225 South Lafayette <br />Boulevard, South Bend, Indiana, to lease space at 224 West <br />Jefferson Boulevard, Suite 216, South Bend, Indiana, for the <br />offices of the City Clerk.
