<br />Common Council that if the City exercises its option to renew this
<br />Lease, the formal process would be followed for the lease of this
<br />property. Mrs. Mueller also advised that Cole Associates was
<br />retained to conduct a study of the conditions in the City Clerk's
<br />office as well as other offices in the County -City Building. It
<br />has been determined that although testing indicated that the air
<br />quality of the former City Clerk's office was acceptable, the
<br />County will perform some steps to eliminate reservoirs in the
<br />building. Therefore, the City has determined to exercise the
<br />option of renewing this Lease for three (3) months.
<br />Therefore, Mr. Caldwell made a motion that the Board adopt
<br />Resolution No. 43-1993, declaring its intent to exercise an option
<br />to extend the Lease of the property at 224 West Jefferson
<br />Boulevard, to accept for filing the proposed Lease, the Auditor's
<br />Certificate and the Petition signed by fifty (50) property owners
<br />in the City of South Bend requesting that the Board exercise an
<br />option to extend the Lease and the setting of a Public Hearing on
<br />this matter for Monday, December 20, 1993-at 9:30 a.m. Mrs.
<br />Manier seconded the motion which carried. The following
<br />Resolution No. 43-1993 was adopted:

<br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND, INDIANA,
<br />DECLARING ITS INTENT TO EXERCISE AN OPTION
<br />TO EXTEND THE LEASE OF THE PROPERTY AT
<br />SUITE 216, 224 WEST JEFFERSON BOULEVARD,
<br />SOUTH BEND, INDIANA, FOR TEMPORARY USE AS THE
<br />SOUTH BEND CITY CLERK'S OFFICE
<br />WHEREAS, on October 11, 1993, the South Bend City Clerk's
<br />Office was temporarily moved on an emergency basis to Suite 216,
<br />224 West Jefferson Boulevard, South Bend, Indiana, as a result of
<br />environmental concerns regarding the former location of the
<br />Clerk's Office on the fourth floor of the County -City Building;
<br />and
<br />WHEREAS, as a result of an investigation by and
<br />recommendations from Cole Associates, Inc., actions will be taken
<br />to eliminate potential biological reservoirs in and around the
<br />former City Clerk's Office, which, in conjunction with cleaning
<br />and disinfection, should alleviate any environmental problems that
<br />may exist in said location; and
<br />WHEREAS, the actions that will be taken to improve
<br />environmental conditions in the former City Clerk's Office will
<br />not be completed until the early spring; and
<br />WHEREAS, the Board of Public Works of the City of South Bend,
<br />Indiana, on December 6, 1993, received a petition ("Petition")
<br />signed by at least fifty (50) taxpayers of the City of South Bend,
<br />requesting that the Board lease the premises at Suite 216, 224
<br />West Jefferson Boulevard, South Bend, Indiana, for a term of three
<br />(3) additional months, commencing on January 11, 1994, for a
<br />monthly rent not to exceed Nine Hundred Thirty-three and 33/100
<br />Dollars ($933.33); and
<br />WHEREAS, the Board also received, on December 6, 1993, a
<br />certificate of the St. Joseph County Auditor, certifying that at
<br />least fifty (50) of the signatories of the Petition are taxpayers
<br />of property located within the corporate limits of the City of
<br />South Bend; and
<br />WHEREAS, the Board has in its possession a lease agreement
<br />for the subject premises executed by the Board on October 11,
