REGULAR MEETING <br />NOVEMBER 1, 1993 <br />the amount of $50.00 for the purchase of the City owned lot at <br />1118 North Burns. The lot was appraised at $750.00. <br />Mrs. Mueller noted that because the Board did not receive a bid <br />for the property which was equal to or in excess of the appraised <br />price, the state statute required that all adjacent property <br />owners be notified that the property was for sale. At this time <br />the legal process has been followed and the Board is in receipt of <br />only one response from Mr. Hauser reiterating his interest in <br />purchasing the property for $50.00. <br />Mrs. Mueller advised the Board that they may decide not to sell <br />the property or they may sell it for any amount with or without <br />conditions. <br />Mrs. Manier informed Board members that she has reviewed the file <br />on this property as well as the offer received and she would <br />recommend that the Board award the bid of Mr. Hauser with the <br />condition that he repair the sidewalk at that location. Mrs. <br />Manier noted that this action would benefit the City. Discussion <br />was held as to the length of time Mr. Hauser would be granted to <br />repair the sidewalk at 1118 North Burns. It was the consensus of <br />members of the Board that May 1, 1994 would be an appropriate <br />date. It was further noted that Mr. Hauser is an employee of the <br />City employed by the Department of Code Enforcement. <br />Therefore, Mrs. Manier made a motion that the vacant City -owned <br />lot at 1118 North Burns be sold to Mr. Peter Hauser for $50.00 <br />with the condition that the sidewalk at that location be repaired <br />no later than May 1, 1994. Mr. Caldwell seconded the motion which <br />carried. <br />Additionally, it was noted that on September 7, 1993, the <br />Board received one (1) bid for the purchase of the City -owned <br />property at 1614 Scott Street. Mrs. Mary Smith, 1618 South Scott <br />Street, South Bend, Indiana, submitted a bid in the amount of <br />$150.00. <br />Members of the Board were reminded that this property was <br />appraised at $430.00. Because the Board did not receive any bids <br />equal to or in excess of the appraised price, pursuant to state <br />statutes, all abutting property owners were advised of the sale of <br />this property. At this time the Board is in receipt of only one <br />reply from Mrs. Smith indicating that she is still interested in <br />purchasing the property for $150.00. <br />Mrs. Manier made motion that the bid of Mrs. Smith in the amount <br />of $150.00 be accepted. Mr. Caldwell seconded the motion which <br />carried. <br />DENY REQUEST FOR RESTRICTED RESIDENTIAL PARKING ZONE - 812-824 <br />ALMOND COURT <br />Mr. Leszczynski advised that on August 23, 1993, the Board <br />received a Petition for the Establishment of a Restricted <br />Residential Parking Zone from 812 Almond Court to 824 Almond <br />Court. <br />Mr. Carl P. Littrell, Director, Division of Engineering, has now <br />advised that the Bureau of Traffic and Lighting conducted a twelve <br />(12) hour investigation of the petition area on September 14, <br />1993. The investigation found that the criteria of the ordinance <br />were not met. Therefore, Mr. Littrell recommends that the Board <br />deny this request. <br />It is noted that South Bend Municipal Code, Chapter 20, Article <br />10, indicates that curb space must be occupied seventy-five per <br />cent (75%) of the time.
