REGULAR MEETING AUGUST 9, 1993
ADOPT RESOLUTION NO. 29-1993 - DISPOSAL OF OBSOLETE PROPERTY
Police Chief Ronald G. Marciniak requested that the Board declare
"MO", a K-9, assigned to the Metro Special Operations Section,
retired and no longer useful to the City. Chief Marciniak noted
that this declaration will authorize the retirement of "MO" and
the presentation of the dog to Corporal Keith Schweizer for use as
a house pet only. Corporal Schweizer agrees to care for "MO" at
his own expense and understands that "MO" can never again be used
as a narcotics detecting dog. Chief Marciniak noted that Corporal
Schweizer has had custody of "MO" since February when his physical
condition deteriorated to the point where he could not perform his
duties.
Mr. Leszczynski advised that the appropriate Resolution has been
prepared declaring this dog as no longer useful to the City.
Therefore, Mr. Caldwell made a motion that the Resolution be
adopted. Mrs. Mueller seconded the motion which carried and the
following Resolution No. 29-1993 was adopted:
OF
RESOLUTION NO. 29-1993
UTION_OF THE SOUTH BEND
OF "MO", A K-9 POLICE DOG
WHEREAS, the South Bend Board of Public Works has been
advised by the City's Police Chief that "Moll, a K-9, assigned to
the Metro Special Operations Section, has a deteriorating physical
condition which prohibits him from performing his duties to the
City; and
WHEREAS, it has been determined by the Board of Public Works
that "Moll is unfit for the purpose for which he was acquired and
is no longer of use to the City of South Bend; and
WHEREAS, Corporal Keith Schweizer has agreed to care for "Moll
at his own expense and to keep him as a house pet and understands
that "Moll can never again be used as a narcotics detecting dog;
and
WHEREAS, I.C. 36-1-11-6(c) permits and establishes a
procedure for disposal of property which is unfit for the purpose
for which it was intended and which is no longer needed by the
City.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works
of the City of South Bend, Indiana, that "Moll, a K-9 Police Dog,
is unfit for the purpose for which he was acquired, is no longer
of use to the City of South Bend, and has an estimated value of
less than One Thousand Dollars ($1,000.00).
BE IT FURTHER RESOLVED, that "Moll, the Police Dog, should be
retired and put into the care of Corporal Keith Schweizer for use
as a house pet only.
Adopted this 9th day of August, 1993.
ATTEST:
s/Sandra M.
