<br />Mr. Mario L. Sims, President, Northwest Side Neighborhood
<br />Association, 1050 North Johnson Street, South Bend, Indiana,
<br />requested permission to close Vassar Street, from Johnson to
<br />O'Brien, each Monday, Wednesday and Friday, from 5:00 p.m. to
<br />8:00 p.m. beginning on July 12, 1993 through August 20, 1993
<br />for recreational purposes.
<br />FOR DESIGNATED HANDICAPPED PARKING SPACE AT 1143 N. HUEY ST.
<br />Ms. Charlotte Morris, 1143 North Huey Street, South Bend,
<br />Indiana, advised the Board that she is handicapped and would
<br />like the parking space in front of her residence designated
<br />as a handicapped parking space.

<br />Mr. Caldwell advised that the above referred to requests, which
<br />were submitted to the Board on May 10, 1993, June 1, 1993, June
<br />21, 1993 and June 28, 1993, have been reviewed by the appropriate
<br />City departments and bureaus and approval is recommended.
<br />Therefore, Mr. Caldwell made a motion that the requests be
<br />approved. Mrs. Mueller seconded the motion which carried.
<br />YlL1NG OF REQUEST FOR PAYMENT OF SUBCONTRACTOR
<br />Board Attorney and Member Mary H. Mueller advised that the Board
<br />is in receipt of a letter from Mr. Timothy W. Woods, Jones,
<br />Obenchain, Ford, Pankow and Lewis, Attorneys and Counselors, 1800
<br />Valley American Bank Building, P.O. Box 4577, South Bend, Indiana,
<br />submitting a Statement of Amount Due. The Statement of Amount
<br />Due, as signed by Mr. A. E. J. McManus, President, Kuert Concrete,
<br />Inc., indicates that pursuant to the provisions of I.C. 36-1-12-
<br />13.1(d), Kuert Concrete, Inc., states that it provided labor and
<br />material for the Sample Street Emergency Sewer Replacement Project
<br />(No. 92-85) through Murdock & Sons Construction, Inc., and that it
<br />was due the sum of $48,151.07 for the labor and material. After
<br />giving credit for all payments and credits, the balance of
<br />$8,151.07 remains due and owing. Demand for payment of the
<br />balance has been made upon Murdock & Sons Construction, Inc., but
<br />it has refused to pay the balance owed to Kuert Concrete, Inc.
<br />The last payment on the account was made by Murdock & Sons
<br />Concrete, Inc., on June 25, 1993.
<br />Board Attorney and Member Mary H. Mueller noted that this document
<br />will be accepted for filing by the Board and that appropriate
<br />Notice will be given to the surety of the Payment Bond for H.R.P.
