005 <br />REGULAR MEETING <br />JANUARY 4, 1993 <br />services at the SLCM tariff. On this tariff, I&M provides <br />metered electric service. The City owns the poles, fixtures and <br />wiring and the City will also be responsible for maintaining them <br />including bulb outages. <br />In conclusion, Mr. Littrell recommended approval of these four <br />(4) Agreements. Therefore, Mr. Leszczynski made a motion that <br />the recommendations be accepted and the Agreements be approved <br />and executed. Mr. Caldwell seconded the motion which carried. <br />APPROVE CHANGE ORDER NO. 1 (FINAL) AND PROJECT COMPLETION <br />AFFIDAVIT - GRIT CHANNEL REBUILDING - WASTEWATER TREATMENT PLANT <br />Mr. Leszczynski advised that Industrial Installations, Inc., <br />55587 Currant Road, Mishawaka, Indiana, has submitted Change <br />Order No. 1 (Final) indicating that the Contract amount be <br />increased by $3,611.00 for a new Contract sum including this <br />Change Order in the amount of $33,371.00. Additionally submitted <br />was the Project Completion Affidavit indicating this new final <br />cost. Upon a motion made by Mr. Leszczynski, seconded by Mr. <br />Caldwell and carried, Change Order No. 1 (Final) and the Project <br />Completion Affidavit were approved and the appropriate three-year <br />Maintenance Bond was accepted for filing. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHT TO REMONSTRATE <br />Mr. Larry D. Spradlin, Sr., Engineering Aide, Division of <br />Engineering, submitted to the Board for consideration a Consent <br />to Annexation and Waiver of Right to Remonstrate as by Mr. <br />David A. Kowalski, President, North Central Indiana Medical <br />Education Foundation, P.O. Box 4394, South Bend, Indiana. <br />The Consent indicates that for permission to tap into public <br />sanitary sewer system of the City to provide sanitary sewer <br />service to two (2) parcels of property described as a tract of <br />land in a part of the Southeast Quarter and the Northeast Quarter <br />of the Southwest Quarter and a part of the Northwest Quarter and <br />the Southwest Quarter of the Southeast Quarter all in Section 29, <br />Township 38 North, Range 3 East, Clay Township, St. Joseph County <br />and a tract of land in a part of the West Half of the Northeast <br />Quarter of Section 32, Township 38 North, Range 3 East, Clay <br />Township, St. Joseph County, North Central Indiana Medical <br />Education Foundation waives and releases any and all right to <br />remonstrate against or oppose any pending or future annexation of <br />the real estate by the City. <br />Mr. Leszczynski noted that these parcels of property are located <br />at Douglas Road and S.R. 23. Therefore, Mr. Leszczynski made a <br />motion that the Consent be approved. Mr. Caldwell seconded the <br />motion which carried. <br />APPROVE REQUEST OF MARTIN LUTHER KING FOUNDATION TO CONDUCT <br />ANNUAL MARCH - JANUARY 18, 1993 <br />Mr. Leszczynski noted that the appropriate City departments and <br />bureaus have reviewed the above referred to request which was <br />submitted to the Board on December 21, 1992, and approval is <br />recommended. Mr. Leszczynski made a motion that the <br />recommendation be accepted and the request be approved. Mr. <br />Caldwell seconded the motion which carried. <br />FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORTS <br />Mr. Leszczynski indicated that the Department of Code Enforcement <br />has submitted two (2) lists containing forty-nine (49) City owned <br />and miscellaneous properties which were cleaned by the Department <br />during the period December 14, 1992 to December 19, 1992. Mr. <br />Leszczynski made a motion that the lists as submitted be accepted <br />for filing. Mr. Caldwell seconded the motion which carried. <br />
