®04 <br />REGULAR MEETING <br />JANUARY 4, 1993 <br />APPROVE ADDENDUM NO. 2 - PROFESSIONAL SERVICES AGREEMENT - <br />COLLEGE FOOTBALL HALL OF FAME - GERARD HILFERTY AND ASSOCIATES <br />Chief Assistant City Attorney Jenny Pitts Manier informed members <br />of the Board that submitted for approval is Addendum No. 2 to the <br />above referred to Agreement which was executed on August 10, <br />1992. <br />Mrs. Manier advised that this Addendum with Gerard Hilferty and <br />Associates, the design architect for the exhibits for the College <br />Football Hall of Fame, makes a few changes in the scope of <br />services concerning placement and handling of artifacts and a <br />timetable to be agreed to by both parties. These are the two (2) <br />major changes. <br />Therefore, Mr. Caldwell made a motion that Addendum No. 2 be <br />approved and executed. Mr. Leszczynski seconded the motion which <br />carried. <br />APPROVE SUBORDINATION OF LIENS NOTICE - WEST WASHINGTON HOMES <br />Chief Assistant City Attorney Jenny Pitts Manier advised that the <br />Subordination of Liens Notice submitted to the Board today for <br />consideration is in regards to the West Washington Homes <br />Partnership. Mrs. Manier noted that this document subordinates <br />the City's mortgage on the property to other financing going into <br />the project which includes the AFL-CIO, Society Bank and Sobieski <br />Federal Savings and Loan Association. Therefore, Mr. Leszczynski <br />made a motion that the Subordination of Liens Notice be approved <br />and executed. Mr. Caldwell seconded the motion which carried. <br />APPROVE AGREEMENTS FOR ELECTRIC SERVICE - INDIANA MICHIGAN POWER <br />COMPANY <br />Mr. Carl P. Littrell, Director, Division of Engineering, advised <br />that the Indiana Michigan Power Company requires four (4) <br />Agreements with the City to provide power for street lighting on <br />Mayflower Road and Nimtz Parkway, which are just finishing <br />construction as follows: <br />1. Application and Agreement for Electric Service <br />New service for street lights <br />3800 North Mayflower Road <br />Nimtz Parkway/Mayflower Road <br />2. Form 3B <br />6661 Nimtz Parkway <br />Nimtz Parkway west of 31 Bypass <br />3. Form 3B <br />5851 Nimtz Parkway <br />Nimtz Parkway near South Bend Wastewater Lift Station <br />4. Form 3B <br />3800 North Mayflower Road <br />Nimtz Parkway near State Police Post <br />The first Agreement requires the City to contribute $9,420.00 to <br />provide the power service. This amount is the difference between <br />the cost of installation of a quarter mile or so of cable and <br />appurtenant items to establish a metered service at the <br />intersection of Nimtz Parkway and Mayflower Road and I&M's <br />expected revenues for the first two and one-half (2 1/2) years of <br />services. This is in accordance with Indiana Utility Regulatory <br />Commission regulations. Two (2) other service points are also <br />being established.
