4 :,5 6 <br />REGULAR MEETING <br />AUGUST 22, 1994 <br />FAVORABLE RECOMMENDATION - VACATION OF 1ST N/S ALLEY E. OF <br />SUNNYSIDE AVENUE FROM THE NORTH R-O-W LINE OF E. BELMONT TO THE <br />SOUTH R-O-W LINE OF EAST SOUTH STREET <br />Mr. Leszczynski indicated that the Common Council has submitted to <br />the Board a Vacation Petition as signed by the following <br />individuals: <br />William R. Matthys <br />1330 <br />East South <br />Street <br />to vacate the following alley: <br />The alley to be vacated is described as the first north - <br />south alley east of S. Sunnyside Avenue from the north <br />right-of-way line of E. Belmont Avenue to the south <br />right-of-way line of E. South Street for a distance of <br />approximately 222.5 feet and a width of 14 feet. Part <br />situated in Whitcomb and Keller's Sunnymede, Third <br />Addition to the City of South Bend, Indiana. <br />Mr. Leszczynski advised that the Board is in receipt of favorable <br />recommendations concerning this Vacation Petition from the Fire <br />Department, Police Department, Division of Environmental Services, <br />Division of Engineering and Area Plan Commission. <br />Therefore, Mrs. Manier made a motion that the Board send a <br />favorable recommendation to the Common Council concerning this <br />Vacation Petition. Mr. Leszczynski seconded the motion which <br />carried. <br />FILING OF APPLICATION FOR CERTIFICATE OF PUBLIC CONVENIENCE - <br />UNIVERSAL CAB COMPANY & LIMO SERVICES, LTD. <br />Mr. Leszczynski noted that on October 12, 1992, Mr. James A. Guy, <br />II, 805 North Johnson, South Bend, Indiana, filed with the Board <br />an application for a Certificate of Public Convenience. At that <br />time, a moratorium was called on the issuance of any more <br />Certificates to operate taxicab companies in order to give the <br />Legal Department time to review, and revise, if necessary, the <br />licensing ordinance governing taxicabs. <br />Since the Board recently lifted this moratorium, Mr. James A. Guy, <br />II, now of 2421 1/2 Bertrand, South Bend, Indiana, has requested <br />that the Board consider his license application. <br />Therefore, Mr. Caldwell made a motion that this application be <br />accepted for filing and that a Public Hearing be conducted on <br />Tuesday, September 6, 1994. Mrs. Manier seconded the motion which <br />carried. <br />APPROVE AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS <br />Mr. Larry D. Spradlin, Sr., Division of Engineering, recommended <br />that the Bond of Contractor for Steve Ullery Construction, 5023 <br />Sage Road, Plymouth, Indiana, be released effective August 15, <br />1994. <br />Additionally, Mr. Dan Weisel, Division of Engineering, recommended <br />that the Board approve the Bond for Excavation in the Streets for <br />Northern Indiana Construction Company, Inc., effective August 22, <br />1994. <br />Therefore, Mr. Leszczynski made a motion that these <br />
