63 <br />REGULAR MEETING <br />JUNE 27, 1994 <br />Resolution No. 26-1994 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO HABITAT FOR HUMANITY OF ST. JOSEPH COUNTY INC. <br />WHEREAS, the City of South Bend, Indiana is the owner of the <br />following described real property situated in St. Joseph County, <br />Indiana: <br />Lot 9 Birdsell's Manufacturing Company's Subdivision of <br />Lot 24 and 25, Denniston & Fellows Addition to the City <br />of South Bend, Indiana. Commonly known as 618 Columbia. <br />Key No.: 18-3026-0960 (hereinafter referred to as the <br />"Real Property"); and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works <br />of the City of South Bend (the "Board") has custody of and may <br />maintain all real property of the City of South Bend; and <br />WHEREAS, Habitat for Humanity of St. Joseph County, Inc. <br />('Habitat") is an Indiana not -for -profit corporation exempt from <br />taxation under Section 501 of the Internal Revenue Code; and <br />WHEREAS, Habitat desires to acquire the Real Property from <br />City for nominal consideration; and <br />WHEREAS, the City desires to transfer the Real Property to <br />H bitat and agrees to such transfer at nominal consideration. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />Oi THE CITY OF SOUTH BEND AS FOLLOWS: <br />1. That the transfer of the following described real <br />pr�operty situated in St. Joseph County, Indiana by the City of <br />South Bend to Habitat for Humanity of St. Joseph County, Inc.: <br />Lot 9 Birdsell's Manufacturing Company's Subdivision of <br />Lot 24 and 25, Denniston & Fellows Addition to the City <br />of South Bend, Indiana. Commonly known as 618 Columbia. <br />Key No.: 18-3026-0960 (hereinafter referred to as the <br />"Real Property") <br />for the sum of One Dollar ($1.00), shall be, and hereby is, <br />approved. <br />2. That the Mayor and City Clerk of the City of South Bend <br />shall be, and hereby are, authorized, respectively, to execute and <br />attest to the execution of a quitclaim deed conveying all right, <br />title and interest in and to the Real Property to habitat upon the <br />occurrence of the condition set forth immediately above. <br />3.
