362 <br />REGULAR MEETING <br />JUNE 27, 1994 <br />Lot 9 Birdsell's Manufacturing Company's Subdivision of Lot <br />24 and 25, Denniston & Fellows Addition to the City of South <br />Bend, Indiana. Commonly known as 618 Columbia. Key No.: 18- <br />3026-0960 (hereinafter referred to as the "Real Property"); <br />and <br />WHEREAS, the Commission, in Resolution adopted on <br />June 24 1994, expressed its desire to transfer the Real Property <br />to the City of South Bend, Indiana; and <br />WHEREAS, the City of South Bend is desirous of acquiring the <br />Real Property from the Commission; and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works <br />of the City of South Bend (the "Board") has custody of and may <br />maintain all real property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, <br />acting by and through the Board, may exchange or transfer property <br />with another governmental entity upon terms and conditions agreed <br />upon,by the two (2) entities as evidenced by the adoption of <br />substantially identical resolutions of each entity; and <br />WHEREAS, the Commission has agreed to transfer the Real <br />Property to the City of South Bend, and the City of South Bend, <br />acting by and through the Board, has agreed to accept the transfer <br />of the Real Property from the Commission for the payment of a <br />nominallconsideration. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND AS FOLLOWS: <br />1. That the transfer of the following described real <br />property situated in St. Joseph County, Indiana by the City of <br />South Bend, Department of Redevelopment, acting by and through the <br />South Bend Redevelopment Commission to the City of South Bend, <br />Indiana <br />Lot 9 Birdsell's Manufacturing Company's Subdivision of <br />Lot 24 and 25, Denniston & Fellows Addition to the City <br />of South Bend, Indiana. Commonly known as 618 Columbia. <br />Key No.: 18-3026-0960 (hereinafter referred to as the <br />"Real Property") <br />for the sum of One Dollar ($1.00), shall be, and hereby is, <br />accepted. <br />2.1 That upon receipt of a fully executed quitclaim deed to <br />the Real Property from the Commission, the Clerk of the Board is <br />hereby authorized and directed to pay to the Commission, on behalf <br />of the Board, the sum of One Dollar ($1.00) and to cause the <br />recording of said quitclaim deed. <br />3.I That this Resolution shall be in full force and effect <br />upon its adoption. <br />this 27th day of June, 1994. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/John E.
