REGULAR MEETING MAY 31, 1994 <br />the subdivision and resale of any portion of the Parcel I or that <br />call for the subdivision and resale of any portion of the Parcel <br />II of 'the Real Estate. <br />18. That the Board will conduct a public hearing on the <br />proposed sale of the Real Estate on the 20th day of June, 1994 at <br />9:30 A.M., 1308 County -City Building, South Bend, Indiana 46601, <br />at which time interested parties and members of the public may <br />speak. <br />19. That an award by the Board of Public Works is made <br />subject to the approval of the Mayor and Common Council of the <br />City of South Bend. <br />20. That award by the Board to the successful bidder must be <br />able to close within ten (10) days of the bid award and approval <br />by the Common Council of the City of South Bend. <br />21. That conveyance of the Real Estate shall be made by <br />warranty deed, executed and attested to, respectively, by the <br />Mayor '';and City Clerk of the City of South Bend, Indiana. The <br />Boardjand City hereby reserves the right to convey the Real <br />Estate', or any portion thereof, subject to restrictive covenants <br />intended to assure compliance with the terms of this offering and <br />bid award. <br />22. That the Real Estate is offered "as is," and no express <br />or implied warranties of any kind are made by the City of South <br />Bend or any of its agencies, officers, employees or agents. <br />213. That the Clerk of the Board shall and is hereby directed <br />to publish notice of the offering of the Real Estate and of the <br />public hearing in accordance with I.C. 5-3-1, setting forth the <br />terms and conditions of the sale. <br />214.
