� M REGULAR MEETING MAY 31, 1994 WHEREAS, pursuant to I.C. 36-10-4-9(a), said lands are under the exclusive control of the Board of Park Commissioners.of the Park District of the City of South Bend (hereinafter, the "Park Board"); and WHEREAS, the Real Property formerly served as housing for the Elbel Golf Course golf professional and is no longer put to that use or needed for that purpose; and WHEREAS, the Park Board has been approached by a number of individuals concerning their interest in purchasing the Real. Property; and WHEREAS, on April 18, 1994, the Park Board determined that the Real Property is no longer required for Park purposes;.and WHEREAS, on April 18, 1994, the Park Board authorized the Board of Public Works of the City of South Bend, Indiana to offer and sell the Real Property as directed by I.C. 36-1-11, subject to approval by the Common Council of the City of South Bend, Indiana of the sale of the Real Property; and WHEREAS, pursuant to I.C. 36-10-4-18, the Common Council of the City of South Bend, Indiana, on May , 1994 passed its Ordinance No. approving the sale of the Real Property subject to the following conditions: 1. That the Real Property be sold at a price no less than the appraised fair market value; and 2. That all proceeds of the sale of the Real Property be returned to the Park Board to be used for park purposes; and WHEREAS, I.C. 36-1-11 requires the Board of Public Works to secure from appraisers who are professionally engaged in making appraisals, licensed under I.C. 25-34.1 or are employees of the City of South Bend familiar with the value of the Real Property, prior to offering the Real Property for sale; and WHEREAS, the Park Board secured appraisals of the Real Property from Ruth Hoover, SRA, of Ruth Hoover, SRA, Inc., and from Dpuglas L. Carpenter, of Douglas L. Carpenter and Associates, both of whom are appraisers who are professionally engaged in making appraisals and licensed under I.C. 25-34.1; and WHEREAS, Ruth Hoover appraised the value of the Real Property as of February 8, 1994 to be $51,400 for Parcel I and $16,000 for Parcel II and Douglas L. Carpenter appraised the value of the Real Property as of February 14, 1994 to be $63,000 for Parcel I and $14,5000 for Parcel II: and WHEREAS, the Board has determined that Ms. Hoover and Mr. Carpenter meet the criteria for appraisers required by I.C. 36-1- 11 and that their appraisals are reliable and competent and, when averaged, properly reflect the fair market value of the Real Estate: and W�EREAS, I.C. 36-1-11-4(c) requires that the Real Property be offered for public sale and that notice of the public sale must be given, said notice to contain certain conditions of the sale. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: 1l.
