05.2 <br />REGULAR MEETING <br />DECEMBER 4. 1995 <br />A part of Lots Numbered Eleven (11) and Twelve (12) as shown on the recorded Plat <br />of Hiram F. Berst's Subdivision of Out Lot 73 of the First Plat of Out Lots of the <br />Town, now City of South Bend, platted by the State Bank of Indiana, which part is <br />bounded by a line running as follows: Beginning at a point 108 feet West of the <br />Northeast corner of Lot 14 in said Subdivision, thence running West on the North <br />line of said Sub -lot 11 to the Northwest corner thereof; thence South on the East line <br />of Chapin Street in said City 71 feet; thence East to a point due South of the place of <br />beginning; thence 71 feet to the place of beginning. Commonly known as 202 <br />Chapin Street. Key No. 18-3050-1947 (hereinafter, the Real Property) <br />and <br />The residential structure located upon the following -described real property situated <br />in St. Joseph County, Indiana: <br />A part of Bank Out Lot Numbered Seventy-one (71) of the First Plat of Bank Out <br />Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, <br />described as beginning at a point 52 feet South of the Northwest corner of said Bank <br />Out Lot Numbered Seventy-one (71), which point is 32 feet South of the Southeast <br />corner of Chapin and Napier Streets in said City of South Bend; thence East on a line <br />32 feet South of and parallel to the South line of said Napier Street, a distance of <br />118.14 feet; thence South 57.1 feet; thence West 118.14 feet to the East line of said <br />Chapin Street; thence North on the East line of said Chapin Street a distance of 57.1 <br />feet to the place of beginning. Commonly known as 306 South Chapin Street, said <br />structure commonly known as the Bivens house (hereinafter, the Structure) <br />and; <br />WHEREAS, the Commission desires to transfer the Real Property and Structure the <br />City of South Bend with the intent and upon the condition that the City of South Bend reconvey the <br />real property to the South Bend Heritage Foundation, Inc. (SBHF) for the sum of One Dollar ($1.00) <br />for use in connection with SBHF's revitalization of the West Washington -Chapin Revitalization Area <br />and with the understanding that SBHF will cause the relocation of the Structure to the Real Property <br />and that the Structure, once relocated to the Real Property, will be rehabilitated to house an African <br />American Resource Center, the same to be completed within twelve (12) months of the relocation <br />of the Structure to the Real Property; and <br />WHEREAS, the City desires to acquire the Real Property and Structure from the <br />Commission upon these terms and conditions; and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of <br />South Bend (the "Board") has custody of and may maintain all real property of the City of South <br />Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and <br />through the Board, may exchange or transfer property with another governmental entity upon terms <br />and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially <br />identical resolutions of each entity. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND AS FOLLOWS: <br />1. That the transfer of the Real Property and Structure, as described above, by the <br />City of South Bend, Department of Redevelopment to the City of South Bend, Indiana for the sum <br />of One Dollar ($1.00), and pursuant to the terms and restrictions set forth above, shall be, and hereby <br />is, accepted. <br />2. That this Resolution shall be in full force and effect upon its adoption. <br />
