0571 <br />REGULAR MEETING DECEMBER 4. 1995 <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and <br />through the Board, may exchange or transfer property with another governmental entity upon terms <br />and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially <br />identical resolutions of each entity. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND AS FOLLOWS: <br />1. That the transfer of the following described improvements to real property situated <br />in St. Joseph County, Indiana by the South Bend Redevelopment Authority to the City of South <br />Bend, Indiana: <br />A pedestrian tunnel and all accessions and fixtures thereto beneath St. Joseph Street, <br />connecting the College Football Hall of Fame and Century Center, all in South Bend, <br />St. Joseph County <br />for the sum of Six Hundred Thousand Dollars ($600,000.00) per parcel, and pursuant to the terms <br />set forth above, shall be, and hereby is, accepted. <br />2. That the acceptance of the conveyance of the Improvements from the Authority <br />is conditioned upon the adoption of a resolution substantially similar in its terms to the terms of this <br />resolution by the South Bend Redevelopment Authority. <br />3. That upon receipt of a fully executed quitclaim deed and/or such other documents <br />evidencing the transfer of title to the Improvements from the Authority to the City, the Clerk of the <br />Board is hereby authorized and directed to pay to Redevelopment, on behalf of the City, the sum of <br />Six Hundred Thousand Dollars ($600,000.00) and to cause the recording of said documents. <br />4. That this Resolution shall be in full force and effect upon its adoption. <br />ADOPTED at the regular meeting of the City of South Bend, Board of Public Works <br />held on December 4, 1995, at 1308 County -City Building, 227 West Jefferson Boulevard, South <br />Bend, Indiana 46601. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/John E.
