REGULAR MEETING NOVEMBER 13, 1995 APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS UNDERGROUND TANK REMOVAL - MUNICIPAL SERVICES FACILITY - PROJECT NO. 95-73 In a memorandum to the Board, Mr. Carl P. Littrell, Director, Division of Engineering, requested permission to advertise for the sale of bids for the above referred to project. Mr. Littrell stated that this project will remove underground fuel storage tanks and dispensing equipment from the Municipal Services Facility. Further, new underground fuel storage tanks were put into service in July and are now fully operational and in compliance with all environmental protection regulations. The items to be removed were installed nearly thirty (30) years ago and would soon reach their life expectancy, and cannot be upgraded to the current standards for such facilities. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the recommendation was approved. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Leszczynski stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Ms. Pamela Brockway. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 60059 Walton Court, South Bend, Indiana, (Key # 01-1122-3762), Ms. Brockway waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Mrs. Manier made a motion that the Consent be approved. Mr. Leszczynski seconded the motion which carried. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Leszczynski stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. Bernard Leblang. The Consent indicates that in consideration for permission to tap into the public water system of the City, to provide water service to a parcel of land being apart of the east half of the northeast quarter of Section 32, Township 3 North, Range 5 East, Clay Township, as described in Exhibit A as submitted, South Bend, Indiana, Mr. Leblang waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Mrs. Manier made a motion that the Consent be approved. Mr. Leszczynski seconded the motion which carried. APPROVE CLAIMS Mr. Kevin Horton, City Controller, submitted claims in the amount of $1,177,343.11 and recommended approval. Mr. Leszczynski made a motion that the claims be approved and the reports as submitted be filed. Mrs. Manier seconded the motion which carried. PRIVILEGE OF THE FLOOR Mr. Leszczynski stated that due to the inclement weather and snowfall during the weekend, the leaf pickup program will continue, but the process will be slower, as snow removal is warranted at this time. The leaf pick up program will most likely be extended.
