REGULAR MEETING NOVEMBER 13, 1995 <br />APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS UNDERGROUND <br />TANK REMOVAL - MUNICIPAL SERVICES FACILITY - PROJECT NO. 95-73 <br />In a memorandum to the Board, Mr. Carl P. Littrell, Director, Division of Engineering, requested <br />permission to advertise for the sale of bids for the above referred to project. Mr. Littrell stated that <br />this project will remove underground fuel storage tanks and dispensing equipment from the <br />Municipal Services Facility. Further, new underground fuel storage tanks were put into service in <br />July and are now fully operational and in compliance with all environmental protection regulations. <br />The items to be removed were installed nearly thirty (30) years ago and would soon reach their life <br />expectancy, and cannot be upgraded to the current standards for such facilities. Therefore, upon a <br />motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the recommendation was <br />approved. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Leszczynski stated that the Board is in receipt of a Consent to Annexation and Waiver of Right <br />to Remonstrate as submitted by Ms. Pamela Brockway. The Consent indicates that in consideration <br />for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer <br />service to 60059 Walton Court, South Bend, Indiana, (Key # 01-1122-3762), Ms. Brockway waives <br />and releases any and all right to remonstrate against or oppose any pending or future annexation of <br />the property by the City of South Bend. Therefore, Mrs. Manier made a motion that the Consent be <br />approved. Mr. Leszczynski seconded the motion which carried. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Leszczynski stated that the Board is in receipt of a Consent to Annexation and Waiver of Right <br />to Remonstrate as submitted by Mr. Bernard Leblang. The Consent indicates that in consideration <br />for permission to tap into the public water system of the City, to provide water service to a parcel <br />of land being apart of the east half of the northeast quarter of Section 32, Township 3 North, Range <br />5 East, Clay Township, as described in Exhibit A as submitted, South Bend, Indiana, Mr. Leblang <br />waives and releases any and all right to remonstrate against or oppose any pending or future <br />annexation of the property by the City of South Bend. Therefore, Mrs. Manier made a motion that <br />the Consent be approved. Mr. Leszczynski seconded the motion which carried. <br />APPROVE CLAIMS <br />Mr. Kevin Horton, City Controller, submitted claims in the amount of $1,177,343.11 and <br />recommended approval. Mr. Leszczynski made a motion that the claims be approved and the <br />reports as submitted be filed. Mrs. Manier seconded the motion which carried. <br />PRIVILEGE OF THE FLOOR <br />Mr. Leszczynski stated that due to the inclement weather and snowfall during the weekend, the leaf <br />pickup program will continue, but the process will be slower, as snow removal is warranted at this <br />time. The leaf pick up program will most likely be extended. <br />
