REGULAR MEETING <br />NOVEMBER 6, 1995 <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Leszczynski stated that the Bogrd is in receipt of a Consent to Annexation and Waiver of Right <br />to Remonstrate as submitted by Debdrah and William Blower. The Consent indicates that in <br />consideration for permission to tap into the public sanitary sewer system of the City, to provide <br />sanitary sewer service to 53130 Nadine Street, South Bend, Indiana, (Key # 02-1158-7461), the <br />Blower's waive and release any and all right to remonstrate against or oppose any pending or future <br />annexation of the property by the City of South Bend. Therefore, Mr. Leszczynski made a motion <br />that the Consent be approved. Mr. Caldwell seconded the motion which carried. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT HOG ROAST - BENCHWARMER' S <br />SPORTS LOUNGE <br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of <br />Engineering, Fire Department, Police Department and the City Attorney's office, in reference to <br />a request as submitted by Mr. Stephen Mitchell, Benchwarmer's Inc., 236 South Michigan Street, <br />South Bend, Indiana, to conduct the above referred to hog roast, on Saturday, November 11, 1995, <br />on the sidewalk in front of Benchwarmer's, from 2:00 p.m. until 12:00 midnight. Mr. Leszczynski <br />noted that alcohol or beer will not be served. Upon a motion made by Mr. Caldwell, seconded by <br />Mrs. Manier and carried, the recommendation was approved. <br />APPROVE LICENSE APPLICATION - SECOND HAND DEALER <br />Mr. Leszczynski stated that the following secondhand dealer's license application has been received: <br />NAME: Bargains Galore <br />BY: Harold Wise <br />ADDRESS: 3316 Mishawaka Avenue <br />FOR THE PURPOSE OF SELLING: Used Items <br />Mr. Leszczynski further advised that favorable recommendations have been received from the <br />Bureau of Traffic and Lighting, Department of Code Enforcement, Police Department and Fire <br />Department concerning the above application. Upon a motion made by Mr. Caldwell, seconded by <br />Mrs. Manier and carried, the above license application was approved and referred to the Deputy <br />Controller's Office for issuance of a license. <br />APPROVAL OF RECOMMENDATION - TO ENCROACH ONTO PUBLIC RIGHT OF WAY <br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of <br />Engineering, Building Department, Redevelopment Design Review Committee, Police Department <br />and the City Attorney's office, in reference to a request as submitted by Mr. Kenneth Johnson, H&F <br />Services, 225 South Lafayette Boulevard, South Bend, Indiana, to install a temporary fiber optic <br />cable from the roof at 225 South Lafayette to the roof of the Trigon Building, as referenced by the <br />drawings submitted. The temporary overhead cable will be removed in the spring of 1996 when a <br />permanent underground cable is installed from H&G Services to Paragon and Paragon to the Trigon <br />Building. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, <br />the recommendation was approved. <br />PETITION FOR THE ESTABLISHMENT OF A RESIDENTIAL PARKING ZONE DENIED - <br />KENMORE STREET FROM WESTERN TO JEFFERSON <br />Mr. Leszczynski stated that an unfavorable recommendation has been received by the Division of <br />Engineering in reference to the request as submitted by Mr. Melton Sanders, 206 South Kenmore, <br />South Bend, Indiana, for the establishment of a residential parking zone on Kenmore from Western <br />to Jefferson Boulevard. Ms. Marcia Qualls, Traffic Investigator, Division of Engineering, stated <br />that a traffic study was preformed on October 26, 1995, and warrants were not met to justify the <br />residential parking zone. South Bend Municipal Code indicates that curb space must be occupied <br />seventy-five (75%) per cent of the time and that the curb space must be occupied twenty-five (25%) <br />per cent of the time by non-residents. Therefore, upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Caldwell and carried, the Petition for the Establishment of a Residential Parking <br />Zone was denied. <br />
