<br />APPROVE PROJECT COMPLETION AFFIDAVIT - SITE CLEARANCE - 202 SOUTH
<br />CHAPIN AND 239-241 SOUTH CHAPIN - DIVISION C - UNDERGROUND STORAGE TANK
<br />REMOVAL - PROJECT NO 95-23
<br />Mr. Caldwell advised that Mr. Ken Herceg, Ken Herceg & Associates, 224 East Jefferson, South
<br />Bend, Indiana, has submitted the Project Completion Affidavit on behalf of Wagoner Excavating,
<br />South Bend, Indiana, for the above referred to project, indicating a final cost of $22,950.00. Upon
<br />a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Project Completion
<br />Affidavit was approved.
<br />APPROVE CHANGE ORDER NO 1 (FINAL) AND PROJECT COMPLETION AFFIDAVIT
<br />CURB AND SIDEWALK PROGRAM - ZONE 11B - PROJECT NO 94-22R
<br />Mr. Caldwell advised that Mr. Bob Allen, Public Construction Manager has submitted Change Order
<br />No. 1 (Final), on behalf of LaPorte Construction, Post Office Box 577, LaPorte, Indiana, indicating
<br />that the contract amount be decreased by $49,412.88 for a new contract sum including this Change
<br />Order in the amount of $86,267.82. Additionally submitted was the Project Completion Affidavit
<br />indicating this new final cost. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and
<br />carried, Change Order No. 1 (Final) and the Project Completion Affidavit were approved subject
<br />to the filing of the appropriate three-year Maintenance Bond.
<br />APPROVE CHANGE ORDER NO 1 (FINAL) AND PROJECT COMPLETION AFFIDAVIT
<br />CURB AND SIDEWALK PROGRAM - ZONE 11 C - PROJECT NO 94-22R
<br />Mr. Caldwell advised that Mr. Bob Allen, Public Construction Manager has submitted Change Order
<br />No. 1 (Final), on behalf of LaPorte Construction, Post Office Box 577, LaPorte, Indiana, indicating
<br />that the contract amount be decreased by $74,006.17 for a new contract sum including this Change
<br />Order in the amount of $67,263.03. Additionally submitted was the Project Completion Affidavit
<br />indicating this new final cost. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and
<br />carried, Change Order No. 1 (Final) and the Project Completion Affidavit were approved subject
<br />to the filing of the appropriate three-year Maintenance Bond.
<br />APPROVE CHANGE ORDER NO 1 (FINAL) AND PROJECT COMPLETION AFFIDAVIT
<br />CURB AND SIDEWALK PROGRAM - ZONE 11A - PROJECT NO 94-22R
<br />Mr. Caldwell advised that Mr. Bob Allen, Public Construction Manger has submitted Change Order
<br />No. 1 (Final), on behalf of LaPorte Construction, Post Office Box 577, LaPorte, Indiana, indicating
<br />that the contract amount be decreased by $48,140.31 for a new contract sum including this Change
<br />Order in the amount of $87,540.39. Additionally submitted was the Project Completion Affidavit
<br />indicating this new final cost. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and
<br />carried, Change Order No. 1 (Final) and the Project Completion Affidavit were approved subject
<br />to the filing of the appropriate three-year Maintenance Bond.
<br />ADOPT RESOLUTION NO. 68-1995 - ACCEPTING THE TRANSFER OF REAL PROPERTY
<br />FROM THE SOUTH BEND REDEVELOPMENT COMMISSION
<br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following
<br />Resolution was adopted by the Board of Public Works:

<br />ACCEPTING THE TRANSFER OF REAL PROPERTY
<br />FROM THE SOUTH BEND REDEVELOPMENT COMMISSION
<br />WHEREAS, the City of South Bend, Department of Redevelopment (Redevelopment),
<br />whose governing body is the South Bend Redevelopment Commission (the "Commission") is the
<br />owner of or is negotiating for the purchase of the following described real property situated in St.
<br />Joseph County, Indiana:
