<br />REGULAR MEETING AUGUST 7, 1995
<br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend
<br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and through the
<br />Board, may exchange or transfer property with another governmental entity upon terms and
<br />conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical
<br />resolutions of each entity; and
<br />WHEREAS, the Commission has agreed to transfer the Real Property to the City of South
<br />Bend and has agreed to assume financial responsibility for the removal of any structures situated
<br />upon any of the Parcels of the Real Estate, and the City of South Bend, acting by and through the
<br />Board has agreed to accept the transfer of the Real Property from the Commission for the payment
<br />of a nominal consideration.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND AS FOLLOWS:
<br />l .That the transfer of the following described real property situated in St. Joseph County, Indiana
<br />by the City of South Bend, Department of Redevelopment, acting by and through the South Bend
<br />Redevelopment Commission to the City of South Bend, Indiana:
<br />1. A lot or parcel of land Fifty-two [52] feet in length, North and South, taken off of and from the
<br />entire width of the North end of Lot Numbered Fifteen [15] as shown on the recorded Plat of
<br />Wenger and Kreighbaum's First Addition to the City of South Bend. Tax Key #: 18-7009-0342
<br />2. Lot Numbered Thirty [30] as shown on the recorded Plat of Wenger and Krieghbaum's First
<br />Addition to the City of South Bend, in St. Joseph County, Indiana, recorded April 2, 1892 in the
<br />Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, Page 1. Tax Key #: 18-
<br />7009-0356
<br />3. Lot Numbered Twenty-three [23] and 2.5 feet West side of Lot Number Twenty-four [24] in the
