Wenger's Sixth Addition to the City of South Bend, recorded April 1, 1903 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 8, page 103, St. Joseph County, Indiana, excepting therefrom a tract of land described as beginning at the Southwest corner of said Lot Numbered One Hundred Sixty (160) running thence North along the West line of said Lot seventy-six (76) feet; thence East forty-two (42) feet; thence South seventy-six (76) feet to a point two (2) feet East on the Southeast corner of Lot Numbered One Hundred Sixty (160); thence West forty-two (42) feet to the place of beginning. That the acceptance of the conveyance of the Real Property from the Commission is conditioned upon the agreement of the Commission to accept financial responsibility for the removal of the structures situated on Parcels II, III, IV, and V, of the Real Property.
