<br />Lot Numbered One Hundred Sixty (160) and a tract of land two (2) feet in
<br />width, East and West, taken off of and from the entire length of the West side
<br />of Lot Numbered One Hundred Fifty-nine (159), as shown on Wengers &
<br />Kreighbaum Replat of a part of M.L. Wenger's Sixth Addition to the City of
<br />South Bend, recorded April 1, 1903 in the Office of the Recorder of St.
<br />Joseph County, Indiana, in Plat Book 8, page 103, St. Joseph County,
<br />Indiana, excepting therefrom a tract of land described as beginning at the
<br />Southwest corner of said Lot Numbered One Hundred Sixty (160) running
<br />thence North along the West line of said Lot seventy-six (76) feet; thence
<br />East forty-two (42) feet; thence South seventy-six (76) feet to a point two (2)
<br />feet East on the Southeast corner of Lot Numbered One Hundred Sixty (160);
<br />thence West forty-two (42) feet to the place of beginning. Key No. 18-7014-

<br />Parcel VI:
<br />All of Lot Numbered One Hundred Fifty-nine (159), excepting therefrom a
<br />strip of land two (2) feet in width, East and West, taken off of and from the
<br />entire length of the West side thereof; also a strip of land two (2) feet in width
<br />East and West taken off of and from the entire length of the West side of Lot
<br />Numbered One Hundred Fifty-eight (158 as shown on the recorded Wenger's
<br />& Kreighbaum Replat of as part of M.L. Wenger's Sixth Addition to the City
<br />of South Bend, recorded April 1, 1903 in the Office of the Recorder of St.
<br />Joseph County, Indiana, in Plat Book 8, page 103. Key No. 18-7014-0530
<br />(hereinafter collectively referred to as the Real Property) and;
<br />WHEREAS, the Commission, in Resolution , adopted on May 5, 1995, expressed
<br />its desire to transfer the Real Property to the City of South Bend, Indiana; and
<br />WHEREAS, the City of South Bend is desirous of acquiring the Real Property from the
<br />Commission, but only upon the condition that the Commission assume financial responsibility for
<br />removing the structures situated upon Parcels II, III, IV, and V of the Real Property; and
<br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend
<br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and through the
<br />Board, may exchange or transfer property with another governmental entity upon terms and
<br />conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical
<br />resolutions of each entity; and
<br />WHEREAS, the Commission has agreed to transfer the Real Property to the City of South Bend,
<br />and has agreed to assume financial responsibility for the removal of the structures situated upon
<br />Parcels II, III, IV, and V of the Real Property, and the City of South Bend, acting by and through the
<br />Board, has agreed to accept the transfer of the Real Property from the Commission for the payment
<br />of a nominal consideration.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE
<br />CITY OF SOUTH BEND AS FOLLOWS:
<br />1. That the transfer of the following described real property situated in St. Joseph County,
<br />Indiana by the City of South Bend, Department of Redevelopment, acting by and through the South
<br />Bend Redevelopment Commission to the City of South Bend, Indiana:
