REGULAR MEETING FEBRUARY 20, 1995 <br />for the sum of One Dollar ($1.00) shall be, and hereby is, approved. <br />2. That upon receipt of a fully executed quitclaim deed to the Real Property from <br />the Commission, the Clerk of the Board is hereby authorized and directed to pay to the <br />Commission, on behalf of the Board, the sum of One Dollar ($1.00) and to cause the recording <br />of said quitclaim deed. <br />3. Jacob, Clerk <br />ADOPT RESOLUTION NO 6-1995 - TRANSFER OF REAL PROPERTY TO NORTHERN <br />INDIANA HISTORICAL SOCIETY <br />Resolution No. 6-1995 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO THE NORTHERN INDIANA HISTORICAL SOCIETY <br />WHEREAS, the City of South Bend, Indiana (the "City") is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />A part of the northeast quarter of Section 11, Township 37 North, Range 2 East, <br />Portage Township, City of South Bend, St. Joseph County, Indiana, described <br />as follows: Lots Numbered 7, 8, and 9 as shown on the recorded Plat of <br />Frederick J. Thomas' Subdivision of the south part of Bank Out Lot Numbered <br />74 of the First Plat of Out Lots of the Town, now City of South Bend, platted <br />by the State Bank of Indiana, recorded April 27, 1860 in Plat Book 1, page 56 <br />(hereinafter the Real Property); <br />and; <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South <br />Bend (the "Board") has custody of and may maintain all real property of the City of South <br />Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-1(b), the City of South Bend, acting by and <br />through the Board, may exchange or transfer property with an Indiana nonprofit corporation <br />organized for educational, literary, scientific, religious, or charitable purposes that is exempt <br />from federal income taxation under Section 501 of the Internal Revenue Code ("Indiana <br />nonprofit corporation") upon such terms and conditions as the parties agree; and <br />WHEREAS, the Northern Indiana Historical Society (NIHS) is an Indiana nonprofit <br />corporation and is desirous of acquiring the Real Property from the City so that NIHS may <br />construct a storage facility upon the Real Property; and <br />
