REGULAR MEETING <br />FEBRUARY 20, 1995 <br />ADOPT RESOLUTION NO. 5-1995 - ACCEPT THE TRANSFER OF REAL PROPERTY FROM <br />SOUTH BEND REDEVELOPMENT COMMISSION <br />Resolution No. 6-1995 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM THE SOUTH BEND REDEVELOPMENT COMMISSION <br />WHEREAS, the City of South Bend, Indiana , Department of Redevelopment <br />(Redevelopment), whose governing body is the South Bend Redevelopment Commission (the <br />"Commission") is the owner of the following described real property stituated in St. Joseph County, <br />Indiana. <br />A part of the northeast quarter of Section 11, Township 37 North, Range 2 East, <br />Portage Township, City of South Bend, St. Joseph County, Indiana, described <br />as follows: Lots Numbered 7, 8, and 9 as shown on the recorded Plat of <br />Frederick J. Thomas' Subdivision of the south part of Bank Out Lot Numbered <br />74 of the First Plat of Out Lots of the Town, now City of South Bend, platted <br />by the State Bank of Indiana, recorded April 27, 1860 in Plat Book 1, page 56 <br />(hereinafter the Real Property); <br />and; <br />WHEREAS, the Commission, in Resolution 1322, adopted on February 17, 1995, <br />expressed its desire to transfer the Real Property to the City of South Bend, Indiana; and <br />WHEREAS, the City of South Bend is desirous of acquiring the Real Property from the <br />Commission; and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South <br />Bend (the "Board") has custody of and may maintain all real property of the City of South <br />Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-1(b), the City of South Bend, acting by and <br />through the Board, may exchange or transfer property with another governmental entity upon <br />terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of <br />substantially identical resolutions of each entity; and <br />WHEREAS, the Commission has agreed to transfer the Real Property to the City of <br />South Bend, and the City of South Bend, acting by and through the Board, has agreed to accept <br />the transfer of the Real Property from the Commission for the payment of a nominal <br />consideration. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />FOR THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />1. That the transfer of the Real Property situated in St. Joseph County, Indiana, by the <br />City of South Bend Department of Redevelopment, acting by and through the South Bend <br />Redevelopment Commission to the City of South Bend, Indiana: <br />A part of the northeast quarter of Section 11, Township 37 North, Range 2 East, <br />Portage Township, City of South Bend, St. Joseph County, Indiana, described <br />as follows: Lots Numbered 7, 8, and 9 as shown on the recorded Plat of <br />Frederick J.
