REGULAR MEETING JANUARY 9, 1995 - TO PURCHASE CITY -OWNED PROPERTY - TWO LOTS BETWEEN 204 AND 214 E. BROADWAY Mr. Fernando Orozco, 204 E. Broadway, South Bend, Indiana, requested permission to purchase two (2) City -owned lots, which are located between his two homes at 204 and 214 E. Broadway. Mr. Orozco is interested in these lots so that his children can have space to play in. ADOPT RESOLUTION NO. 1-1995 - TRANSFER OF REAL PROPERTY Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the following Resolution No. 1-1995 was adopted: RESOLUTION NO. 1-1995 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE TRANSFER OF A CERTAIN PARCEL OF REAL PROPERTY TO NOTRE DAME CHAPTER OF HABITAT FOR HUMANITY WHEREAS, the City of South Bend, Indiana, (hereinafter the "City"), is the owner of a parcel of real property situated in the City of South Bend, St. Joseph County, Indiana, and being more particularly described as follows: Key No. 18-5100-3540 Lot 78 Hartman & Millers Plat Commonly known as 1113 Burns Avenue; and WHEREAS, the care, custody and control of City -owned real estate is vested in the Board of Public Works pursuant to I.C. 36-9-6-3 and 36-1-11-1, et seq.; and WHEREAS, the Notre Dame Chapter of Habitat for Humanity (hereinafter "Habitat"), an Indiana not -for -profit corporation meeting the requirements of I. C. 3 6-1-11 (a) (7), desires to obtain ownership of the above -described real estate for the purpose of constructing a single-family home on this property, which will provide a home ownership opportunity for low-income individuals in the community; and WHEREAS, the use of said property for such purposes will be beneficial to the community, and the City is willing to transfer said property to Habitat for the construction of said single-family home. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indian, as follows: 1) The City shall transfer to Habitat one (1) parcel of real property more particularly described as follows: Key No. 18-5100-3540 Lot 78 Hartman & Millers Plat Commonly known as 1113 Burns Avenue; and 2) Such transfer shall be accomplished by a Quit -Claim Deed, executed by the Mayor of the City of South Bend and attested to by the South Bend City Clerk. 3) Such transfer shall be made by the City to Habitat in an "as is" condition with no warranties, indemnities or representations made relative to said real property.
