Plat of "Wenger's 6th Addition to the City of South Bend First Replat & Wengers & <br />Krieghbaum's Replat of a part of M.L. Wenger's 6th Addition to the City of South <br />Bend Second Replat" recorded as Document No. 9639730 in the Records of the St. <br />Joseph County Recorder's Office. Subject to all legal highways, easements and <br />restrictions of record. <br />for Ten Dollars ($10.00) and subject to the conditions set forth hereinabove, by the City of South <br />Bend, Indiana to the South Bend Heritage Foundation, Inc., shall be, and hereby is, approved. <br />2. That the Mayor of the City of South Bend and the South Bend City Clerk shall be, and <br />hereby are, authorized, respectively, to execute and attest to the execution of a quitclaim deed <br />conveying all of the right, title and interest of the South Bend Heritage Foundation, Inc. <br />3. That this Resolution shall be in full force and effect upon its adoption by the Board of <br />Public Works of the City of South Bend. <br />ADOPTED at a meeting of the Board of Public Works of the City of South Bend held on <br />December 9, 1996 at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, <br />Indiana 46601. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/John E. Jacob, Clerk <br />ADOPT RESOLUTION NO. 86-1996 - DISPOSAL OF CITY -OWNED PROPERTY - 2221 AND <br />2215 SMITH STREET <br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 86 - 1996 <br />WHEREAS, the Board of Public Works of the City of South Bend, Indiana, has compiled a <br />current detailed inventory of all real property owned by the City of South Bend; and <br />WHEREAS, the Board of Public Works has reviewed said inventory of real property and it <br />finds that certain parcels of real estate now owned by the City of South Bend are not necessary to the <br />public use and are not set aside by State and City laws for public purposes; and <br />WHEREAS, the Board of Public Works finds that the properties described below have an <br />assessed valuation of less than $2,000.00, that the cost of maintaining said parcels equals or exceeds <br />the estimated fair market value of the parcel, and that the highest and best use of the parcels is sale <br />to an abutting landowner. <br />WHEREAS, the Board of Public Works now wishes to take the necessary action to make it <br />possible for the Board, in the future, to sell said parcels of real estate pursuant to State statutes. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend, Indiana: <br />1. That the parcels of real estate owned by the City contained in the following list is <br />not necessary to the public use, is not set aside by State or City laws for public <br />purposes, that the cost of maintaining said parcel equals or exceeds the estimated fair <br />marW value of said parcels and the highest and best use of said parcels is sale to an <br />
