Subject to all legal highways, easements and <br />restrictions of record. <br />(collectively hereinafter referred to as the Real Property); and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend <br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and <br />WHEREAS, the City, through the Board, is desirous of transferring the South Heritage <br />Foundation, Inc. (SBHF), a non-profit corporation, exempt from income taxation under Section <br />503© of the Internal Revenue Code, for use in its Sample -Ewing Development Area house move <br />project; and <br />WHEREAS, pursuant to I.C. 36-1-11-1(b), the City, acting by and through the Board, may <br />transfer property to an Indiana non-profit corporation, exempt from income taxation under Section <br />5030 of the Internal Revenue Code, under such terms and conditions as determined by the Board. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />FOR THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally <br />described as follows: <br />A part of the Northeast Quarter of Section 13, T. 37 N. R. 2 E., Portage Township, <br />City of South Bend, St. Joseph County, Indiana which is described as: Lot "A" of <br />the Plat of "Wenger's 6th Addition to the City of South Bend First Replat & Wengers <br />& Krieghbaum's Replat of a part of M.L. Wenger's 6th Addition to the City of South <br />Bend Second Replat" recorded as Document No. 9639730 in the Records of the St. <br />Joseph County Recorder's Office.
