<br />WHEREAS, the public hearing was held pursuant to the notice and the Resolution, _
<br />written remonstrances were filed, and all interested persons were heard at the public hearing; and
<br />WHEREAS, on October 28, 1996, the South Bend Common Council adopted Resolution 96-
<br />105, entitled A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL DETERMINING,
<br />AFTER INVESTIGATION, THAT THE LEASE OF OFFICE SPACE AT 205 WEST JEFFERSON
<br />BOULEVARD, SOUTH BEND, INDIANA, FOR THE USE OF THE CITY OF SOUTH BEND,
<br />DEPARTMENT OF ECONOMIC DEVELOPMENT, DIVISION OF PLANNING AND
<br />NEIGHBORHOOD DEVELOPMENT, IS NEEDED wherein the Common Council of the City of
<br />South Bend, Indiana, determined the lease of the premises is necessary.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
<br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
<br />1. That Resolution 76-1996 adopted by the Board on October 28, 1996, with respect to the
<br />lease of the premises is in all respects ratified and confirmed.
<br />2. That the rental to be paid pursuant to the lease is fair and reasonable.
<br />3. The Board hereby authorizes the execution of the Lease, as modified, and any and all
<br />documents necessary to give effect to the lease and the intent of this resolution.
<br />4. Pursuant to I.C. 36-1-10-13, the Clerk of the Board is instructed to give notice of the
<br />execution of the Lease by publication in the South Bend Tribune and Tri-Countyews, newspapers
<br />of general circulation, published in the City of South Bend, with notice to be published one (1) time,
<br />within thirty (30) days of this date.
<br />Adopted on the 18th day of November, 1996, by the Board of Public Works of the City of
<br />South Bend, Indiana.

<br />There being no one else present wishing to address the Board concerning this matter, the Public
<br />Hearing was closed. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and
<br />carried, the lease was approved and executed.
<br />PUBLIC HEARING - TRANSIENT MERCHANT LICENSE -_FIFTH ANNUAL KRIS KRINGLE
<br />CRAFT SHOW
<br />Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning a
<br />Transient Merchant License, as submitted by Ms. Elinor Tyl, 1154 East LaSalle, South Bend, Indiana,
<br />to conduct the Fifth Annual Kris Kringle Craft Show, at Union Station, 310 West South Street, South
<br />Bend, Indiana, on Sunday, December 1, 1996, from 9:00 a.m. until 4:00 p.m., for the sale of arts and
<br />crafts.
<br />Mr. Martin Tyl, 1154 East LaSalle, South Bend, Indiana, was present, and stated that this was their
<br />fifth annual craft show, and recommended approval. There being no one else present wishing to
<br />address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion
<br />made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Application for a Transient
<br />Merchant License was approved.
