<br />APPROVAL OF REQUEST TO PARK ON WASHINGTON STREET SIDE OF LASALLE PARK
<br />- PUBLIC SPEAKING AFFAIR
<br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of
<br />Engineering, Police Department, Board of Park Commissioners and the City Attorney's office, in
<br />reference to a request as submitted by Mr. Melvin Townsend, Post Office Box 3361, South Bend,
<br />Indiana, to park on the Washington Street side of LaSalle Park, to conduct the above referred to
<br />public affair, on Saturday, June 15, 1996, from 7:00 a.m. until 9:00 p.m. Therefore, upon a motion
<br />made by Mr. Caldwell, seconded by Mrs. Manier and carried, the recommendation was approved,
<br />subject to an Indemnification to be signed by Mr. Townsend.
<br />APPROVAL OF RELEASE OF CLAIM
<br />Mr. Leszczynski stated that Ms. Marcia Qualls, Traffic Investigator, has submitted a Release and
<br />Settlement for Transport Carriers, Inc., 14151 Mellon Drive, Detroit Michigan, for a claim for
<br />damages incurred to City property at the intersection of Lombardy and Western on December 6,
<br />1995. Ms. Qualls stated that the sum of the damages, $5,251.16, has been paid in full. Therefore,
<br />upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Release of Claim
<br />and Settlement was approved.
<br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE
<br />Mr. Leszczynski stated that the Board is in receipt of a Consent to Annexation and Waiver of Right
<br />to Remonstrate as submitted by Bob and Tamara McDonald. The Consent indicates that in
<br />consideration for permission to tap into the public sanitary sewer system of the City, to provide
<br />sanitary sewer service to 60097 Fellows Street, South Bend, Indiana, (Key # 01-1071-2327), the
<br />McDonald's waive and release any and all right to remonstrate against or oppose any pending or
<br />future annexation of the property by the City of South Bend. Therefore, Mrs. Manier made a motion
<br />that the Consent be approved. Mr. Leszczynski seconded the motion which carried.
<br />APPROVE CONTRACTOR BONDS
<br />Mr. Larry D. Spradlin, Sr., Engineer, Division of Engineering, recommended that the following
<br />Contractor Bonds be approved as follows:
<br />BOND OF CONTRACTOR
<br />Fred Aichele Approved June 10, 1996, Retroactive to June 5, 1996
<br />Alfredo Ramirez Approved June 10, 1996, Retroactive to June 8, 1996
<br />Mr. Leszczynski made a motion that the recommendation be accepted and that the Bonds be
<br />approved as outlined above. Mr. Caldwell seconded the motion which carried.
<br />APPROVE CLAIMS
<br />Mr. Kevin Horton, City Controller, submitted claims in the amount of $823,262.89, dated June 10,
<br />1996, and recommended approval. Mr. Leszczynski made a motion that the claims be approved and
<br />the reports as submitted be filed. Mr. Caldwell seconded the motion which carried.
