123 <br />REGULAR MEETING MARCH 25, 1996 <br />NO RECOMMENDATION - PETITION TO VACATE AN ALLEY <br />Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition <br />as completed by Mr. Thomas Keller, 710 JMS Building, South Bend, Indiana to vacate the following <br />alley: <br />A part of the southeast quarter of Section 1, Township 37 North, Range 2 East, Portage <br />Township, City of South Bend, St. Joseph County, Indiana, and also being a part of Lot 8 shown <br />on the recorded plat of Siron's First Addition to the Town of Lowell in Book 1, Page 53 in the <br />Office of the St. Joseph County, Indiana Recorder's Office and being more particularly described <br />as follows: <br />Beginning at the intersection of the east right-of-way line of Notre Dame Avenue and the south <br />right-of-way line of the first east/west alley south of South Bend Avenue; thence east along said <br />south line of the east/west alley to a point 20 feet west of the intersection of said south line of the <br />east/west alley and the west line of the first north/south alley eat of Notre Dame Avenue; thence <br />north to the north line of said east/west alley to the east right-of-way line of Notre Dame Avenue; <br />thence south to the place of beginning. The east/west alley described was created by the Board <br />of Public Work Condemnation Resolution Number 13 dated May 6, 1994. <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />and the Department of Economic Development. Mr. Caldwell stated that he spoke to the residents <br />in the area, and this vacation would affect the way of living in the area. Therefore, Mrs. Manier <br />made a motion that the Board send no recommendation to the Common Council concerning this <br />Vacation Petition. Mr. Caldwell seconded the motion which carried. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT WALKTOBERFEST - AMERICAN <br />DIABETES ASSOCIATION <br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of <br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to a <br />request as submitted by Mr. Chad Stanton, American Diabetes Association, 115 South Lafayette, <br />South Bend, Indiana to conduct the above referred to walk, on Sunday, October 6, 1996, from 8:00 <br />a.m. until 1:00 p.m., on the designated route as submitted. Therefore, upon a motion made by Mrs. <br />Manier, seconded by Mr. Leszczynski and carried, the recommendation was approved. <br />APPROVE LICENSE APPLICATIONS - PUBLIC PARKING FACILITY <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the following <br />license applications were approved: <br />Center City Associates, Inc. <br />100 South Michigan & Jefferson <br />400 South Main <br />100 North Michigan <br />300 South Michigan <br />The above licence applications were approved and referred to the Deputy Controller's Office for <br />issuance of a license. It was noted that the required Proof of Insurance as well as the hours and rates <br />to be charged was attached to the applications. <br />APPROVE LICENSE APPLICATION - SECOND HAND DEALER <br />Mr. Leszczynski stated that the following secondhand dealers license applications have been <br />received: <br />NAME: Red's Pawn Shop <br />BY: Stephen Krupnik <br />ADDRESS: 1072 Lincolnway East <br />FOR THE PURPOSE OF SELLING: Unredeemed pledges <br />
