F <br />REGULAR MEETING JANUARY 2, 1996 <br />for a new Contract sum including this Change Order in the amount of $51,172.00. Mrs. Manier <br />stated that this increase represents a 21.8% increase in the cost of the public work, and in this <br />instance, of the proposed increase resulted from changes Willson had to make after it was discovered <br />that the actual building site was several feet north of the original site plan. As a result, Willson was <br />forced to extend the retaining wall and add infill along the south property line. Although the <br />majority of the expenses contained in Change Order No. 1 represent an increase in the scope of the <br />project, $1,608.00, or 4% of the contract amount, represents expenses attributable to unforeseen <br />circumstances. Therefore, this change order actually only increases the scope of the project within <br />the meaning of I.C. 36-1-12-18 (d), by 17.8%. Upon a motion made by Mr. Caldwell, seconded by <br />Mrs. Manier and carried, the Change Order was approved. <br />APPROVE PROJECT COMPLETION AFFIDAVIT - ORGANIC RESOURCES BUILDING <br />ADDITION/VENTILATION UPGRADE - PROJECT NO. 95-09 <br />Mr. Leszczynski advised that Mr. Roberto Flores, Division of Environmental Services, has <br />submitted the Project Completion Affidavit on behalf of Ziolkowski Construction, 1005 South <br />Lafayette Boulevard, South Bend, Indiana, for the above referred to project, indicating a final cost <br />of $168,150.00. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, <br />the Project Completion Affidavit was approved. <br />APPROVE PROJECT COMPLETION AFFIDAVIT - YORK ROAD DRAINAGE CONTROL <br />STRUCTURE -PROJECT NO. 93-45 <br />Mr. Leszczynski advised that Mr. Bob Allen, Public Construction Manager, has submitted the <br />Project Completion Affidavit on behalf of Herrman and Goetz, 225 South Lafayette Boulevard, <br />South Bend, Indiana, for the above referred to project, indicating a final cost of $9,600.00. Upon <br />a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Project Completion <br />Affidavit was approved. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT CROP WALK <br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of <br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to <br />a request as submitted by Mr. Rob Ercoline, Church World Service, 54191 North Ironwood, South <br />Bend, Indiana to conduct the above referred to CROP Walk, on Saturday, January 27, 1996, from <br />4:00 p.m. until 4:30 p.m., on the designated route as submitted. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Caldwell and carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br />INSTALLATION OF AWNING AT 123 WEST WASHINGTON <br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of <br />Engineering, Redevelopment Design Review Committee, Police Department, Building <br />Commissioner and the City Attorney's office, in reference to a request as submitted by Mr. Gene <br />V. Stauffer, Stauffer & Associates Enterprises, Inc., 56844 Inwood Court, Elkhart, Indiana for <br />installation of an awning for a new restaurant to be opened at 123 West Washington in downtown <br />South Bend. Upon a motion made by Mr. Leszczynski , seconded by Mrs. Manier and carried, the <br />recommendation was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE TWO ALLEYS <br />Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition <br />as completed by Mr. James A Masters, Nemeth, Feeney & Masters, P.C., 307 Norwest Bank <br />Building, South Bend, Indiana to vacate the following alleys: <br />The first east -west alley east of South Main Street running south from West Garst Street; and <br />the first east -west alley west of South Michigan street running west from South Michigan <br />Street situated in the City of South Bend, St. Joseph County. <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mrs. <br />Manier made a motion that the Board send a favorable recommendation to the Common Council <br />
