s <br />REGULAR MEETING <br />NOVEMBER 3, 1997 <br />BOARD UP SERVICES CONTRACTOR - TABLED <br />Assistant Fire Chief Bert Prawat, South Bend Fire Department was present, and stated to the Board <br />that Mr. Charles Howell, High Tech, 905 Western Avenue, South Bend, Indiana, requested to be <br />added to the Emergency Board -up List. Chief Prawat stated that High Tech was removed from the <br />list by the Board of Public Works last week, as they failed to respond to board -up calls from the Fire <br />Department and Police Department. They had not responded five (5) times during the months of <br />September and October. In addition, there have been problems with Mr. Charles Howell and his son, <br />William, within their corporation. Mr. Charles Howell was present, and stated that he is working on <br />solving his problems. The unresponsive calls made by the City were to his son, William, who did not <br />follow up on the requests as received. They are in the process of reorganizing the corporation. Mr. <br />Howell stated that he has money invested in his company and the City, and would respond to calls. <br />Mr. Dave Smith, a High Tech stockholder, was present, and stated that High Tech would be able to <br />handle all the work. The situation with unresponsiveness was out of High Tech's control. <br />Mr. Caldwell made a motion to table the issue, until the time that the Fire Department could evaluate <br />the situation and make a recommendation to the Board. This would be the second time the Board <br />would give High Tech the opportunity to abide by the Board up Contract. Ms. Roemer seconded the <br />motion which carried. <br />DISCLOSURE TO THE BOARD OF PUBLIC WORKS FILED <br />In a letter to the Board, Ms. Kathryn Baumgartner, Bureau of Housing, stated that Ms. Josephine <br />Scott applied to the Bureau's Affordable Home Repair Program. Ms. Scott is the mother of <br />Ernestine Ligon, who is an employee of the Bureau of Housing. Upon a motion made by Mr. <br />Caldwell, seconded by Ms. Roemer and carried, the Public Disclosure was filed. <br />LICENSE APPLICATION FOR GARBAGE AND RUBBISH REMOVAL SERVICE DENIED <br />Mr. Caldwell stated that the Board is in receipt of an unfavorable recommendation from the <br />Department of Code Enforcement for a License Application for a Rubbish and Garbage Removal <br />Service, as submitted by Mr. Herbert Howard/Carolyn Patterson, 227 North Studebaker, South Bend, <br />Indiana. The Department of Code Enforcement has stated that Mr. Howard, on many occasions, has <br />brought his truck to the address at 227 North Studebaker full of trash, and has parked it there. Upon <br />a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the License Application was <br />denied. <br />ADOPT RESOLUTION NO. 84-1997 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 84-1997 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January <br />11, 1988, Ordinance No. 7847-88 which mandates the Board of Public Works of the City of South <br />Bend to determine that the sidearm of a police officer who retires in good standing is surplus property <br />and no longer useful to the City of South Bend; and <br />WHEREAS, CORPORAL LARRY R. ERNSBERGER has retired from the South Bend <br />Police Department after twenty-three (23) years of service and the Board of Public Safety of the City <br />of South Bend has determined that he has retired in good standing; and <br />WHEREAS, I.C. 36-1-11-6 permits and establishes procedure for disposal of personal <br />property which is no longer needed by the City and which is unfit for the purpose for which it was <br />intended; <br />1 <br />1 <br />1 <br />
