0 <br />REGULAR MEETING MARCH 10, 1997 <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY <br />Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr.John Wigfall, 1126 West Washington, South Bend, Indiana, to vacate the following <br />alley: <br />The first north -south alley east of South Maple Street from the south right of way of West <br />Washington Street to the north alley line of the first east -west alley south of West Washington <br />Street for a distance of approximately 144.5 feet in length and a width of 14 feet. Part <br />located in Evan's Sub of B.O.L. 88 and Bakers Sub of B.O.L. 87, City of South Bend, St. <br />Joseph.County, Indiana. <br />Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from theArea Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Ms. <br />Roemer made a motion that the Board send a favorable recommendation to the Common Council <br />concerning this Vacation Petition. Mr. Littrell seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY <br />Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr..John Roxy, 519 South St. Joseph Street, South Bend, Indiana, to vacate the <br />following alley: <br />The first east -west alley south of East Monroe Street from the west right-of-way line of South <br />St. Joseph Street to the east line of the first north -south alley west of South Saint Joseph <br />Street for a' distance of approximately 165 feet and a width of approximately 14 feet. Part <br />situated in the Taylor Field Addition in the City of South Bend, St. Joseph County, Indiana. <br />The Board of Public Works received favorable recommendations from the Fire Department, <br />Department of Economic Development, Bureau of Sanitation, and the Police Department concerning <br />this vacation, subject to any utility easements that may be required. The Area Plan Commission has <br />reviewed the petition, and it is in their opinion that is does not meet the test of I.C. 36-7-3-13(2) in <br />that, "The vacation would make access to the lands of the aggrieved person by means of a public way <br />difficult or inconvenient." Vacation of this. alley would deny access to the parcel on the south side <br />of the alley located on the back third of Lot 13. Seven feet (half of the vacated alley) will not be <br />sufficient for a vehicle to access the parking area located on this property. In addition, the property <br />owner of the back third of Lot 13 and the property owner adjacent to the alley to the north have not <br />signed the petition to vacate. While this may not affect the legality of the petition, it is the opinion of <br />Area Plan that it is important to note that the property owner who will be denied access by this <br />vacation has not signed the petition to vacate. The Division of Engineering concurs with Area Plan. <br />Therefore, upon a motion.made by Mr. Caldwell, seconded by Ms. Roemer and carried, the Board <br />will send an unfavorable recommendation to the City Council concerning this alley vacation. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT WEST SIDE MEMORIAL PARADE <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to a <br />request as submitted by Ms. Adeline Jaskowiak, 727 South Illinois, South Bend, Indiana,. to conduct <br />the above referred to parade, on Monday, May 26, 1997, on the designated route as submitted. Upon <br />a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the recommendation was <br />approved. <br />APPROVE TRAFFIC CONTROL DEVICE <br />Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the following traffic <br />control device was approved: <br />New Installation <br />No Parking Tow Zone <br />3616 Northside - north and <br />south side of street <br />
