Powell, Member <br />Upon a motion made by Mr. Powell, seconded by Ms. Roemer and carried, the following Resolution <br />I as adopted by the Board of Public Works: <br />RESOLUTION NO. 57-1998 <br />RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA <br />BOARD OF PUBLIC WORKS <br />INDICATING WILLINGNESS TO ACCEPT <br />WATER QUALITY MANAGEMENT PLANNING RESPONSIBILITIES <br />WHEREAS, the Clean Water Act, as amended, requires the development and implementation <br />of water quality management plans for the purpose of preventing further degradation of our streams; <br />and <br />WHEREAS, pursuant to Section 208 of the Act, the Governor of the State of Indiana has <br />designated area wide waste treatment management agencies that are responsible for water quality <br />management in such areas; and <br />WHEREAS, pursuant to Section 208, the Commissioner of the Indiana Department of <br />Environmental Management has designated specific local units of government and management <br />agencies,, for the purpose of implementing various pollution control measures and practices <br />recommended in the State's Water Quality Management Plan; and <br />WHEREAS, pursuant to Section 303 (e) Indiana has implemented an approved continuing <br />planning process; and <br />WHEREAS, a process exists by which all municipal units of government and special districts <br />who intend to abate pollution may enter in to the State Revolving Fund process for the purpose of <br />constructing wastewater collection and treatment facilities; and <br />WHEREAS, the City of South Bend desires to abate water pollution within its area of legal <br />jurisdiction; and <br />WHEREAS, the City of South Bend further desires to be in compliance with the requirements <br />for obtaining a loan for the purpose of this control; and <br />WHEREAS, the Environmental Protection Agency, Region V, has directed that only an <br />approved designated management agency can be the recipient of a State Revolving Fund Financial <br />Assistance Award. <br />NOW, THEREFORE, be it resolved that the City of South Bend Board of Public Works <br />desires to be the approved designated management agency for the control of water pollution sources <br />within its area of legal jurisdiction. <br />BE IT RESOLVED by the City of South Bend Board of Public Works on June 22, 1998 at <br />a regularly scheduled meeting of the Board. <br />BOARD OF PUBLIC WORKS <br />s/James R.
