REGULAR MEETING MAY 26, 1998 <br />Commencing at the intersection of the Westerly right-of-way line of Lafayette Street and the <br />North right-of-way line of Sample Street also being the Southeast corner of Tract No. 3 <br />Studebaker Corp. Replat; thence North 0°00'29" West along said Westerly right-of-way line, <br />a distance of 177.48 feet to the place of beginning; thence North 90°00'00" West a distance <br />of 399.58 feet to the East property line of Newman and Altman property; thence North <br />0°03'03" West along said East property line, a distance of 106.53 feet; thence South <br />89°55'49" East, a distance of 399.64 feet to the West right-of-way line of said Lafayette <br />Street; thence South 0°00'29" East along said West right-of-way line a distance of 106.05 feet <br />to the place of beginning; and <br />A parcel of land being a part of the Southeast Quarter of Section 11, Township 37 North, <br />Range 2 East, Portage Township, St. Joseph County, Indiana and being more particularly <br />described as follows: <br />Commencing at the intersection of the Westerly right-of-way line of Lafayette Street and the <br />North right-of-way line of Sample Street also being the Southeast corner of Tract No. 3 <br />Studebaker Corp. Replat; thence North 0°00'29" West along said Westerly right-of-way line <br />a distance of 177.48 feet; thence North 90"00'00" West, a distance of 3 99.5 6 feet to the East <br />property line of the Newman and Altman property; thence North 0°03'03" West along said <br />East property line, a distance of 111.62 feet to the place of beginning also being the Northeast <br />corner of said Newman and Altman property; thence North 89° 58'00" West along the North <br />property line of said Newman and Altman property a distance of 291.06 feet to the <br />Northwest corner of said Newman and Altman property; thence North 4°46'43" East a <br />distance of 39.42 feet; thence North 2° 19'06" East, a distance of 35.17 feet; thence North <br />89°59'44" East, a distance of 125.98 feet; thence South 0°00'00" East, a distance of 35.22 <br />feet; thence South 89°58'00" East, a distance of 160.37 feet; thence South 0°02'00" West, <br />a distance of 40.00 feet to the place of beginning (The "Property"). <br />WHEREAS, the Department of Redevelopment, acting by and through the South Bend <br />Redevelopment Commission, previously retained the services of two appraisers to ascertain the fair <br />market value of the Property; and <br />WHEREAS, purchase offers have been extended for all property necessary to construct the <br />Jail; and <br />WHEREAS, the offer to purchase the aforementioned Property has not been accepted. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend as follows: <br />1. All actions heretofore by the Department of Redevelopment and the South Bend <br />Redevelopment Commission, including but not limited to the appointment of appraisers and the <br />extension of the offer to purchase the Property hereby ratified. <br />2. In the event the purchase offer is not accepted, the Legal Department is authorized and <br />directed to file a complaint in the name of the City of South Bend, Indiana, in order that appraisers <br />be appointed to establish the value of said real estate, and all other necessary and proper actions be <br />taken to accomplish the taking by eminent domain pursuant to law. <br />Adopted this 26th day of May, 1998. <br />BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND, INDIANA <br />s/James R.
