164 <br />REGULAR MEETING <br />APRIL 27,1998 <br />is recommended, subject to the alley being blocked on the south end. Lots 69 and 70 are owned by <br />separate individuals. It is recommended that this alley vacation not be approved unless ingress and <br />egress easement is signed by both parties. Both parties have garages in the alley. <br />Mr. James Crne, 608 West Angela, South Bend, Indiana, was present. Mr. Crane stated that he <br />represented thirty-seven petitioners advising of denying the alley vacation. The vacation would hinder <br />the normal exit access. The vacated area would be used as a playground, making this a danger to the <br />children in the neighborhood. In addition, the petitioners have had Code violations, and use excessive <br />speeds in the alleyways. Mr. Mary Robbin Wood, 620 West Angela, South Bend, Indiana, was <br />present, and stated that there would be a danger to the safety of the neighborhood children if this alley <br />were to be vacated. <br />Therefore, Mr. Caldwell made a motion that the Board send an unfavorable recommendation to the <br />Common Council concerning this Vacation Petition. Ms. Roemer seconded the motion which <br />carried. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT MARCH FOR JESUS <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to a <br />request as submitted by Ms. Ellen Stanley, Post Office Box 1573, Mishawaka, Indiana to conduct the <br />above referred to march, on Saturday, May 30,1998, beginning at 10:00 a.m., on the designated route <br />as submitted. Upon a motion made by Ms. Roemer, seconded by W. Littrell and carried, the <br />recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT MULTIPLE SCLEROSIS WALK <br />Mr. Caldwell. stated that favorable recommendations have been received by the Division of <br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to a <br />request as submitted by Mr. Greg Bennett, Memorial Health and Lifestyle Center, 401 East Colfax, <br />South Bend, Indiana to conduct the above referred to walk, on Saturday, May 2, 1998, beginning at <br />9:00 a.m., on the designated route as submitted. Upon a motion made by Mr. Caldwell, seconded <br />by Ms. Roemer and carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT AMERICAN HEART WALK <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to a <br />request as submitted by Ms. Deborah Puecker, American Heart Association, 2410 North Grape Road, <br />Mishawaka, Indiana to conduct the above referred to walk, on Saturday, September 19,1998, <br />beginning at 8:30 a.m., on the designated route as submitted. Upon a motion made by Mr. Caldwell, <br />seconded by Ms. Roemer and carried, the recommendation was approved. <br />APPROVAL OF LICENSE APPLICATION - RUBBISH AND GARBAGE REMOVAL SERVICE <br />Mr. Caldwell stated that the Board is in receipt of favorable recommendation from the Department <br />of Code Enforcement for a License Application for a Rubbish and Garbage Removal Service, as <br />submitted by Mr. Kurtis Rochefort, K&D Hauling, 812 Division, Mishawaka, Indiana. It was noted <br />that the Bureau of Sanitation has inspected the vehicles to be used in conjunction with this business, <br />and have found them to be satisfactory. Upon a motion made by Mr. Caldwell, seconded by Ms. <br />Roemer and carried, the License Application was approved. <br />APPROVE LICENSE APPLICATION - OPEN AIR STAND <br />Mr. Caldwell advised that the a License Application for an Open Air Stand has been received from <br />Mr. James F. Haag, South Bend Shrine Club, 50561 Ironwood, South Bend, Indiana, to conduct the <br />sale of onions at Ireland and Main and Marion on April 18, 1998. Mr. Caldwell further advised that <br />favorable recommendations have been received from the Police Department, Department of Code <br />Enforcement, and the Bureau of Traffic and Lighting for the above application. Additionally provided <br />with the application was a letter of permission from the property owner. Upon a motion made by Ms. <br />Roemer seconded by Mr. Caldwell and carried, the above license application was approved and <br />referred to the Deputy Controller's Office for issuance. <br />
