135 <br />REGULAR MEETING <br />APRIL 13 J 998 <br />APPROVE AND ADOPT AMENDED RESOLUTION NO. 36-1998 <br />Upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the following Resolution <br />was adopted by the Board of Public Works. The previous Resolution contained a paragraph that <br />should not have been in the Resolution: <br />RESOLUTION NO. 36-1998 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND, INDIANA, ACCEPTING TITLE TO <br />A CERTAIN PARCEL OF REAL ESTATE COMMONLY KNOWN <br />AS 511 SOUTH MICHIGAN STREET, SOUTH BEND, INDIANA <br />WHEREAS, the Board of Public Works ("Board") has custody of all real property owned by <br />the City of South Bend; and <br />WHEREAS, as a result of an agreement between the City of South Bend and the owners of <br />the property commonly known as 511 South Michigan Street, South Bend, Indiana, a copy of which <br />is attached hereto, a Warranty Deed has been delivered from the owners of the property to the City <br />of South Bend to transfer the following described parcel of real property: <br />Key number: 18 3017 0631 <br />The South One-third (1/3) of Lot Numbered Twenty (20) as shown on the recorded Plat of <br />Samuel Martin's Addition to the City of South Bend recorded in the Office of the Recorder <br />of St. Joseph County, Indiana, in Plat Book 3, page 28, <br />and commonly described as 511 South Michigan Street, <br />to the City of South Bend; and <br />WHEREAS, the Board of Public Works, acting on behalf of the City of South Bend, has <br />accepted transfer of the deed to the above mentioned parcel; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section I. That the Board of Public Works hereby accepts an ownership interest in the <br />following described parcel of real property: <br />Key number: 18 3017 0631 <br />The South One-third (1/3) of Lot Numbered Twenty (20) as shown on the recorded Plat of <br />Samuel Martin's Addition to the City of South Bend recorded in the Office of the Recorder <br />of St. Joseph County, Indiana, in Plat Book 3, page 28, <br />and commonly described as 511 South Michigan Street. <br />Section II. The Clerk of the Board is instructed to give notice of the adoption of this <br />resolution to the Office of the Recorder and the Office of the Treasurer for St. Joseph County, <br />Indiana immediately upon its execution, and to take any and all other necessary and proper actions <br />to effectuate this acceptance. <br />Adopted on the 13th day of April, 1998, by the Board of Public Works of the City of South <br />Bend, Indiana.
