A <br />REGULAR MEETING MARCH 22,_1999 <br />APPROVAL OF REQUEST TO CONDUCT PUBLIC AUCTION/AGREEMENT = UNCLAIMED <br />PROPERTY - KASER' S AUCTION SERVICE - <br />Mr. Caldwell stated that in a letter to the Board, Chief Richard Kilgore, Police Department, requested <br />,permission to conduct a public auction to dispose of unclaimed property as allowed by law. In <br />addition, the Board is in receipt of an Agreement between the City of South Bend and Kaser's <br />Auction Service, 67601.Pine Road, North Liberty, Indiana, to conduct the auction on Saturday, April <br />24, 1999, in the garage area at the rear of 701 West Sample; South Bend, Indiana. Mr. Caldwell <br />noted that the Agreement is in the amount of eight (8) percent commission. Therefore, upon a <br />motion made by Mr. Caldwell, seconded by Ms. -Roemer and carried, the Request to Conduct a Public <br />Auction and the Agreement were approved and executed. <br />ADOPT RESOLUTION NO. 14 - 1999 - AMENDING RESOLUTION 8-1.999 ENTITLED "A <br />RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE _CITY OF SOUTH BEND, <br />WITH SAID BUILDING CORPORATION" <br />Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 144999 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF <br />SOUTH BEND, INDIANA, AMENDING RESOLUTION 8-1999 ENTITLED <br />"A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF <br />SOUTH BEND, INDIANA, REGARDING THE SALE OF CERTAIN <br />PROPERTY TO THE CITY OF SOUTH BEND BUILDING CORPORATION <br />AND THE APPROVAL OF AN AGENCY AGREEMENT WITH SAID <br />BUILDING CORPORATION" <br />WHEREAS, the City of South Bend, Indiana (the "City" ), has previously executed <br />a lease (the "Lease") whereby the City shall lease the proposed fire station to be constructed near the <br />intersection of York and Jackson Roads in the City (the "Fire Station Project") and the Municipal <br />Services Facility of the City located at 701 West Sample Street in the City (the "Services Building <br />Project") (collectively, the "Project") from the City of South Bend Building Corporation (the <br />'Building Corporation"); and <br />WHEREAS, construction of the Project is to be financed by the Building Corporation <br />through the issuance of its first mortgage bonds; and <br />WHEREAS, the City desires to sell the property upon which the Fire Station Project <br />will be located and the Services Building to the Building Corporation, said property being described <br />as set forth in the Lease (the "Property"); and <br />WHEREAS, this Board of Public Works of the City of South Bend, Indiana, did <br />previously adopt its Resolution Number 8-1999 regarding the sale of the Property to the City of <br />South Bend Building Corporation and approving an agency agreement with said Building <br />Corporation; and <br />WHEREAS, Resolution 8-1999 ratified the appointment of Bernard Diedrich and <br />Philip Krause as appraisers for purposes of appraising the Property; and <br />WHEREAS, the appraisers have amended their appraisals which resulted in a change <br />to the appraised value of the Property which is subject to the Lease; and <br />WHEREAS, the average of the two revised appraisals is One Million Eight Hundred <br />Seventy-eight Thousand and 00/100 Dollars ($1,878,000); and <br />I— <br />
