REGULAR MEETING NOVEMBER 27, 2000 WHEREAS, the South Bend Redevelopment Commission, at its meeting of December 1, 2000, has or will adopt its Resolution No. approving the transfer of the Real Property to the City for One Dollar and 00/100 ($1.00) and upon the terms described hereinabove. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS FOR THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS THAT: The transfer of the Property situated in St. Joseph County, Indiana for One and 00/100 ($1.00) and upon the terms set forth hereinabove, by the City of South Bend, Indiana, Department of Redevelopment to the City of South Bend, Indiana, shall be, and hereby is, accepted. 2. The Clerk of the Board of Public Works shall cause the recording of the Quit Claim Deed conveying the Property to the City of South Bend, Indiana upon the receipt of the same. 3. This Resolution shall be in full force and effect upon its adoption by the Board of Public Works of the City of South Bend. ADOPTED at a meeting of the Board of Public Works of the City of South Bend held on November 27, 2000, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601. Jacob, Clerk ADOPT RESOLUTION NO. 120-2000 - AUTHORIZING THE TRANSFER OF REAL PROPERTY TO SOUTH BEND PUBLIC TRANSPORTATION CORPORATION Upon a motion made by Ms. Roemer, seconded by Mr. Inks and carried, the following Resolution was adopted by the Board of Public Works: WHEREAS, the City of South Bend, Indiana (hereinafter the "City"), owns or is in the process of acquiring the real property and improvements situated in the City of South Bend, St. Joseph County, Indiana, and being more particularly descried as follows: Lot lettered "A" as shown on the recorded Plat of Leighton Plaza Re -plat of the City of South Bend Original Plat recorded June 15, 1999 as Document Number 9927350 in the Office of the Recorder of St. Joseph County, Indiana. (hereinafter the "Property") WHEREAS, said Property was not obtained by the City through eminent domain; and WHEREAS, the care, custody and control of the City real estate is vested in the Board of Public Works pursuant to I.C. 36-9-6-3; and WHEREAS, the City and South Bend Public Transportation Corporation have previously executed a Contract for Purchase and Sale of Real Estate and a Commercial Lease relating to the Property as a co-operative effort of City and South Bend Public Transportation Corporation to build up the community's intermodal transportation system; and
