<br />3. For and in consideration of such transfers, the County shall the city, the sum of One
<br />and 00/100 Dollar ($1.00). The City shall assume all recording costs and any transfer
<br />fees associated with such transfer.
<br />4. That this Resolution shall be in full force and effect upon its adoption.
<br />ADOPTED at a meeting at the Board of Public Works of the City of South Bend, Indiana
<br />held on September 25, 2000, at 1308 County -City Building, 227 West Jefferson Boulevard, South
<br />Bend, Indiana 46601.

<br />ADOPT RESOLUTION NO. 104-2000 - APPROVING THE TRANSFER OF REAL PROPERTY
<br />TO ST. JOSEPH COUNTY, INDIANA/ST. JOSEPH COUNTY JAIL SITE
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Inks and carried, the following Resolution
<br />was adopted by the Board of Public Works. Ms. Ann Kolata, Community and Economic
<br />Development, was present, and stated that this Resolution transfers real property to the St. Joseph
<br />County Jail site.
<br />WHEREAS, the City of South Bend, Indiana (hereinafter, the "City") is the owner of the
<br />certain real property situated in St. Joseph County, Indiana and being more particularly described as
<br />Exhibit "A", hereto (hereinafter referred to as the `Real Property"); and
<br />WHEREAS, the care, custody and control of City real estate is vested in the City's Board of
<br />Public Works (hereinafter the "Board") pursuant to I.C. 36-9-6-3; and
<br />WHEREAS, the City is desirous oftransferring the Property to St. Joseph County (hereinafter
<br />the `County") for the sum of One and 00/100 Dollar ($1.00) and other good and valuable
<br />consideration; and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, City, acting by and through the Board, may
<br />exchange or transfer property with another governmental entity upon terms and conditions agreed
<br />upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each
<br />entity; and
<br />WHEREAS, the Board of Commissioners of St. Joseph county, Indiana (hereinafter the
<br />"Commissioners:), at its meeting of October 3, 2000 will consider its Resolution No. accepting
<br />the transfer of the Property from the City of South Bend, by and through its Board of Public Works.
<br />NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE
<br />CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
<br />That the transfer of the Property situated in St. Joseph county, Indiana, and more
<br />particularly described as Exhibit "A" attached hereto, by the City of South Bend,
<br />Indiana to St. Joseph County, Indiana, for the sum of One and 00/100 Dollar ($1.00)
<br />shall be, and hereby is, accepted, subject tot he adoption of a resolution by the Board
<br />of Commissioners of St. Joseph County, Indiana substantially identical in its terms and
<br />conditions as the resolution.
<br />2. Such transfer shall be accomplished by a quit claim deed executed by the City.
