<br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS
<br />ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY
<br />WHEREAS, it has been determined by the Board of Public Works that the following property is
<br />unfit for the purpose for which it was intended and is no longer needed by the City of South Bend:
<br />MISCELLANEOUS COMPUTER EQUIPMENT
<br />(SEE ATTACHED)
<br />WHEREAS, Indiana Code 36-1-11-60 permits and establishes procedure for disposal of
<br />personal property which is unfit for the purpose for which it was intended and which is no longer
<br />needed by the City.
<br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works ofthe City of South
<br />Bend that the items listed above are no longer needed by the City; are unfit for the purpose for which
<br />they were intended and have an estimated value of less than five thousand dollars ($5,000.00).
<br />BE IT FURTHER RESOLVED, that said items may be transferred or sold at public auction
<br />or private sale, without advertising. However, if the property is deemed worthless, such may be
<br />demolished or junked.
<br />ADOPTED this 19th Day of September, 2001.

<br />ADOPT RESOLUTION NO. 56-2001 - RECOMMENDING THE ISSUANCE AND SALE OF
<br />BONDS FOR THE PURPOSE OF REFUNDING OUTSTANDING CITY OF SOUTH BEND
<br />INDIANA SEWAGE WORKS REFUNDING REVENUE BONDS OF 1993 • AND APPROVING
<br />AND AUTHORIZING OTHER ACTIONS IN RESPECT THERETO
<br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the following Resolution was
<br />adopted by the Board of Public Works:
<br />RESOLUTION NO.2001-56
<br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA,
<br />RECOMMENDING THE ISSUANCE AND SALE OF BONDS FOR THE PURPOSE OF REFUNDING
<br />OUTSTANDING CITY OF SOUTH BEND, INDIANA SEWAGE WORKS REFUNDING REVENUE BONDS OF
<br />1993; AND APPROVING AND AUTHORIZING OTHER ACTIONS IN RESPECT THERETO
<br />WHEREAS, the City of South Bend, Indiana (the "City") has established, constructed and
<br />financed a sewage works and now owns and operates said sewage works pursuant to IC 36-9-23, as
<br />amended, and other applicable laws.
<br />WHEREAS, the City has previously issued its bonds authorized by Ordinance No. 7951-88,
<br />passed by the Common Council of the City (the "Common Council") on December 12, 1988, and
<br />designated as "City of South Bend, Indiana Sewage Works Revenue Bonds of 1988" (the "1988
<br />Bonds").
<br />WHEREAS, the 1988 Bonds were advance refunded with the proceeds of bonds authorized
<br />by Ordinance No. 8359-93, passed by the Common Council on March 8, 1993, and amended by
<br />Ordinance No. 8364-93, passed by the Common Council on March 22,1993 (collectively, the "1993
<br />Ordinance"), and designated as "City of South Bend, Indiana Sewage Works Refunding Revenue
<br />Bonds of 1993," issued in the original amount of $10,080,000, dated April 1, 1993 (the "1993
<br />Bonds"), of which $5,642,500 is currently outstanding.
