REGULAR MEETING AUGUST 13, 2001 <br />court at Nimtz Parkway. Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the <br />recommendation was approved. <br />ADOPT RESOLUTION NO.46-2001 - AMENDING CONTRACT FROM THE SALE OF LAND <br />FOR PRIVATE DEVELOPMENT <br />Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the following Resolution was <br />adopted by the Board of Public Works: <br />RESOLUTION NO. 46-2001 <br />WHEREAS, on April 27, 1997, the City of South Bend ("City") and Memorial Health System, <br />Inc. ("Memorial") entered into a contract for a sale of land for private development for certain <br />property in the City of South Bend, which contract is attached hereto as Exhibit "A"; <br />WHEREAS, said contract imposed certain obligations on Memorial to develop the property and <br />contained certain restrictions upon Memorial transferring the property; <br />WHEREAS, Memorial, not having developed the property, now desires to sell this land, along <br />with certain adjacent property to the Young Women's Association St. Joseph county an Indiana not - <br />for -profit corporation, (YWCA) for development; and <br />WHEREAS, the Cit of South Bend believes it is in the best interest of the health, safety, and <br />welfare of the City and its residents that to YWCA bed allowed to develop the land. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend, Indiana, that: <br />The City of South Bend, by its Board of Public Works, consents to the sale of property by <br />Memorial to YWCA, subject to the conditions set forth below; <br />2. The City of South Bend by its Board of Public Works releases Memorial from its obligation <br />under the 1997 contract subject to the conditions set forth below; and <br />3. The condition for the consent to sale and release from liability of Memorial is the YWCA <br />agrees to restrictions similar to the attached Exhibit "A". <br />ADOPTED this 13t' day of August 2001. <br />BOARD OF PUBLIC WORKS <br />s/Carl P. Littrell, Member <br />s/Donald E. Inks, Member <br />FILING OF SAFETY REPORT - CENTRAL SERVICES <br />Central Services submitted a Safety Report for July 2001. The report will reflect injuries/accidents <br />for each month and provide for a comparison.
