REGULAR MEETING DECEMBER 9, 2002
<br />Order on behalf of Small, Inc., 25190 State Road 4, North Liberty, Indiana indicating that the
<br />Contract amount be decreased by $622.05 for a new Contract sum including this Change Order in
<br />the amount of $25,737.95. Additionally submitted was th Project Completion Affidavit indicating
<br />the new final cost. Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the Final
<br />Change Order and Project Completion Affidavit were approved.
<br />APPROVE CHANGE ORDER NOS. 3, 4 AND 5 - BIKE PEDESTRIAN TRAIL - NORTHERN
<br />INDIANA CONSTRUCTION - PROJECT NO. 99-051
<br />Mr. Gilot advised that Mr. Toy Villa, Public Construction Manager, has submitted Change Order
<br />Nos. 3, 4 and 5 on behalf of Northern Indiana Construction, 55803 Dogwood Road, Mishawaka,
<br />Indiana indicating that the Contract amount be increased $59,122.82 for a new Contract sum
<br />including this Change Order in the amount of $919,710.87. Upon a motion made by Mr. Littrell,
<br />seconded by Mr. Inks and carried, the Change Orders were approved.
<br />APPROVE CHANGE ORDER NO. 6 - BIKE PEDESTRIAN TRAIL - NORTHERN INDIANA
<br />CONSTRUCTION - PROJECT NO. 99-051
<br />Mr. Gilot advised that Mr. Toy Villa, Public Construction Manager, has submitted Change Order
<br />No. 6 on behalf of Northern Indiana Construction, 55803 Dogwood Road, Mishawaka, Indiana
<br />indicating that the Contract amount be decreased $43,322.50 for a new Contract sum including this
<br />Change Order in the amount of $876,218.37. Upon a motion made by Mr. Littrell, seconded by Mr
<br />Inks and carried, the Change Order was approved.
<br />REQUEST TO WRITE-OFF UNCOLLECTIBLE UTILITY ACCOUNTS FOR 2002 - WATER
<br />WORKS
<br />Mr. Andy Wierzbicki, Water Works, presented a report of unsuccessfully collected accounts for the
<br />Solid Waste Operations, Water Works Operations, Sewer Repair Insurance, Sewage Works
<br />Operations, Water Leak Insurance and Project Releaf. The accounts that have been in a finalled
<br />status for at least one year with collection efforts futile. The State Board of Accounts requires these
<br />write-offs must be submitted to the Board for approval. Upon a motion made by Mr. Gilot, seconded
<br />by Mr. Inks and carried, the write-off of uncollectible utility accounts for 2002 was approved.
<br />APPROVAL OF REQUEST FOR PERMANENT/TEMPORARY EASEMENT - LOT 2 OF B.W.
<br />BUSINESS PARK MAJOR SUBDIVISION
<br />Mr. Gilot stated that the Board is in receipt of memorandum from Mr. Robert Case, Economic
<br />Development, requesting a permanent/temporary easement at the above location for land and space
<br />to construct and operate new bridge on the Olive Road Bridge Reconstruction at the Toll Road.
<br />Therefore, upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the request was
<br />approved.
<br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE
<br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to
<br />Remonstrate as submitted by Mr. Charles Hafer, 56825 Butternut Road, South Bend, Indiana. The
<br />Consent indicates that in consideration for permission to tap into the public water system of the City,
<br />to provide water service to Lot 52, Hollywood Second Addition, South Bend, Indiana, (Key #17-
<br />1040-1262 ), Mr. Hafer waives and releases any and all right to remonstrate against or oppose any
<br />pending or future annexation of the property by the City of South Bend. Therefore, Mr. Gilot made
<br />a motion that the Consent be approved. Mr. Littrell seconded the motion which carried.
<br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE
<br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to
<br />Remonstrate as submitted by Place Realty, Inc., 2133 Foxboro Court, Mishawaka, Indiana. The
<br />Consent indicates that in consideration for permission to tap into the public water and sanitary sewer
<br />system of the City, to provide water and sanitary sewer service to Laurel Creek Subdivision, a part
<br />of the north half of the south 40 acres of a 78 parcel of land, South Bend, Indiana. Garden Place
<br />waives and releases any and all right to remonstrate against or oppose any pending or future
<br />annexation of the property by the City of South Bend. Therefore, Mr. Gilot made a motion that the
<br />Consent be approved. Mr. Littrell seconded the motion which carried.
