172 <br />REGULAR MEETING JUNE 24, 2002 <br />ADOPT RESOLUTION NO. 39-2002 - APPROVING AND AUTHORIZING THE EXECUTION <br />OF AN AGENCY AGREEMENT BY AND BETWEEN THE SOUTH BEND REDEVELOPMENT <br />COMMISSION AND THE CITY OF SOUTH BEND, INDIANA, BOARD OF PUBLIC WORKS <br />RELATING TO THE TJX REDEVELOPMENT PROJECT (SAMPLE-EWING DEVELOPMENT <br />AREA) <br />Upon a motion made by Mr. Inks, seconded by Mr. Gilot and carried, the following Resolution was <br />adopted by the Board of Public Works, subject to the address correction (Olive and Chapin Street <br />should be corrected to read Olive and Sample Streets): <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission") is the owner <br />of property located in the Sample -Ewing Development Area in the general vicinity of the Olive and <br />Chapin Streets (should read Sample Streets)("Property"); and <br />WHEREAS, as part of a redevelopment project with the TJX Companies, Inc. ("TJX") <br />wherein TJX will construct an 800,000 square foot distribution center (the "TJX Project"), the <br />Commission intends to demolish certain existing buildings and to undertake new construction of <br />streets and other infrastructure improvements at or near the Property; and <br />WHEREAS, the Board ofPublic Works (the "Board") and the Commission desire to enter into <br />an agency agreement wherein the Board shall act as the Commission's agent with respect to the <br />demolition and construction ofthe Project and other related matters, a copy of said Agency Agreement <br />is attached hereto and incorporate herein as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED, by the City of South Bend, Indiana, Board of <br />Public Works as follows: <br />Section 1. The Board hereby approves of the Agency Agreement and hereby authorizes <br />its execution in substantially the form attached hereto an Exhibit "A" with <br />such changes as the Board may deem necessary or appropriate upon the advice <br />of counsel, and execution thereof to be conclusive evidence of the Board's <br />approval of such changes. The Clerk is hereby directed to file a copy of the <br />Agency Agreement with the Commission. <br />Section 2. Jacob, Clerk <br />APPROVAL OF AGREEMENTS FOR THE PURPOSE OF TEMPORARY RIGHT -OF -ENTRY - <br />KELLER PARK NEIGHBORHOOD <br />Ms. Sherece Tolbert, Planning Department, stated that these Agreements are for the purpose of <br />temporary right of entry, granting the Keller Park Neighborhood Association two (2) six foot <br />easements in the right-of-way at Riverside Drive and Academy; and Portage at Kessler. The Keller <br />Park Neighborhood will install two neighborhood gateway signs. Upon a motion made by Mr. Gilot, <br />seconded by Mr. Inks and carried, the Temporary Rights of Entry were approved, subject to <br />verification with the property owners. <br />APPROVAL OF LETTER AGREEMENT - RETURNING EASEMENT TO CITY OF SOUTH <br />BEND - KELLER PARK NEIGHBORHOOD ASSOCIATION <br />Ms. Sherece Tolbert, Planning Department, stated that the Keller Park Neighborhood Association <br />wishes to give back to the City of South Bend the easement granted at the properties located at <br />Woodlawn and Portage; and Woodlawn at Riverside Drive.
