REGULAR MEETING APRIL 22, 2002 <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mr. Gilot <br />made a motion that the Board send a favorable recommendation to the Common Council concerning <br />this Vacation Petition. Mr. Littrell seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET- FIRST <br />EAST/WEST ALLEY NORTH OF BARTLETT STREET <br />Mr. Gilot indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Ms. Anne Bruneel, Baker & Daniels, 205 West Jefferson, South Bend, Indiana to <br />vacate the following street: <br />The first east/west alley north of Bartlett Street from the east right of way line of Lafayette <br />Boulevard east to the east right of way line of the first north/south alley east of Lafayette <br />Boulevard for a distance of 179 feet and a width of 13 feet. Being a part of Vinson's Subdivision <br />in the City of South Bend, St. Joseph County, Indiana. <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mr. Gilot <br />made a motion that the Board send a favorable recommendation to the Common Council concerning <br />this Vacation Petition. Mr. Littrell seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET - SCHULMAN <br />DRIVE FROM OLIVE STREET TO GRANT STREET <br />Mr. Gilot indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Michael Danch, Danch, Harper & Associates, Inc., 2422 Viridian Drive, South <br />Bend, Indiana to vacate the following street: <br />Schulman Drive (formerly Davis Drive) from Olive Street to Grant Street for a distance of <br />1,067.6 feet and a width of 60 feet. The second street to be vacated is Grant Street from sample <br />Street to the north line of the Indiana Northern Railway Company right of way. <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mr. Inks <br />made a motion that the Board send a favorable recommendation to the Common Council concerning <br />this Vacation Petition. Mr. Littrell seconded the motion which carried. <br />APPROVAL OF RECOMMENDATION - TO CLOSE STREET - FORD FROM CARLISLE TO <br />WARREN STREET - BENEFIT FOR CORPORAL RAY WOLFENBARGER <br />Mr. Gilot stated that favorable recommendations have been received by the Division of Engineering, <br />Police Department and the City Attorney's office, in reference to a request as submitted by Ms. <br />MaryAnn Myers, Mayor's Office, to conduct the above referred to event on April 19, 2002, from <br />6:00 p.m. until 9:00 p.m. Upon a motion made by Mr. Littrell, seconded by Mr. Gilot and carried, <br />the recommendation was approved. <br />ADOPT RESOLUTION NO.22-2002 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 22-2002 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the right <br />and duty to have custody of, control of, use of, and dispose of in accordance with Indiana statutes, <br />all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January 9, <br />1995, Ordinance No. 8570-95 which states that upon retirement with twenty (20) or more years of <br />
