0329 <br />REGULAR MEETING <br />SEPTEMBER 8, 2003 <br />APPROVAL OF RECOMMENDATION - TO CONDUCT RILEY HIGH SCHOOL <br />HOMECOMING PARADE <br />Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting, Park <br />Department, Police Department and the City Attorney's office, in reference to a request as submitted <br />by Dr. James Cohen, Riley High School, 1902 South Fellows, South Bend, Indiana to conduct the <br />above referred to parade, on September 19, 2003, from 5:00 p.m. until 7:00 p.m., on the designated <br />route as submitted. Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the <br />recommendation was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - 165' EAST OF <br />30TH STREET, RUNNING NORTH OFF PLEASANT STREET APPROXIMATELY 410' MORE <br />OR LESS <br />Mr. Gilot indicated that Mr. Blake Unger, Gospel Center Church, 930 South 30" Street, South Bend, <br />Indiana, has submitted a request to vacate the above referred to alley. Mr. Gilot advised that the <br />Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area <br />Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic <br />Development and the Department of Public Works. Engineering stated that the petitioner must <br />provide a cross access easement to 30t" Street for the stub alley from Mishawaka Avenue. In <br />addition, if this alley is vacated, it be done so subject to any utility easements that are necessary. <br />Therefore, Mr. Gilot made a motion that the Clerk send a letter to the petitioner addressing these <br />concerns. Mr. Littrell seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - JEFFERSON <br />BOULEVARD LOCATED BETWEEN CHAPIN STREET AND THE FIRST NORTH/SOUTH <br />ALLEY WEST TO CHAPIN STREET; REMAINDER OF SAID NORTH/SOUTH ALLEY, <br />LYING BETWEEN THOMAS STREET AND WASHINGTON STREET <br />Mr. Littrell indicated that Mr. Mike Danch, South Bend Heritage Foundation, South Bend, Indiana, <br />has submitted a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Police Department, Fire Department, Sanitation, Department of Economic <br />Development and the Department of Public Works. Engineering stated that the properties at Key <br />Numbers 18-3054-2097, 2099, 2100 and 2101 depend upon this alley for access. Cross access <br />agreements will be needed for those property owners to allow this vacation. In addition, if this alley <br />is vacated, it be done so subject to any utility easements that are necessary. Therefore, Mr. Inks <br />made a motion that the Clerk send a letter to the petitioner addressing these concerns. Mr. Littrell <br />seconded the motion which carried. <br />ADOPT RESOLUTION NO. 65-2003 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 65-2003 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY <br />WHEREAS, it has been determined by the Board of Public Works that the following property is <br />unfit for the purpose for which it was intended and is no longer needed by the City of South Bend: <br />ONE (1) 1993 CHEVY CAVALIER, VIN #1G1JC5447P7115999 <br />WHEREAS, Indiana Code 5-22-22-1 permits and establishes procedure for disposal of <br />personal property which is unfit for the purpose for which it was intended and which is no longer <br />needed by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend that the item listed above is no longer needed by the City; is unfit for the purpose for which <br />it was intended and has an estimated value of less than five thousand dollars ($5,000.00). <br />�1 <br />1 <br />
