0295 <br />REGULAR MEETING AUGUST 11, 2003 <br />recommendations concerning this Vacation Petition from the Area Plan Commission, Police <br />Department, Fire Department, Sanitation, Department of Economic Development and the <br />Department of Public Works, as follows: Area Plan does not recommend that this right of way be <br />vacated. The vacation of the alley and the construction of a garage may inhibit the access to adjacent <br />properties. If the alley is to be vacated, Area Plan recommends it be done so subject to any utility <br />easements that are necessary. Community and Economic Development stated the vacation would <br />create a dead end alley. The Fire Department stated that it appears that the residents at 417 Napoleon <br />will not have access to the rear of their property. Therefore, Mr. Gilot made a motion that the Clerk <br />send a letter to the petitioner addressing these concerns. Mr. Littrell seconded the motion which <br />carried. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT A.B.A.T.E. MOTORCYCLE RIDE <br />FOR MUSCULAR DYSTROPHY <br />Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting, Police <br />Department and the City Attorney's office, in reference to a request as submitted by Mr. Chris <br />Moore, Freedom Cycle, 6210 U.S. 31 South, South Bend, Indiana, to conduct the above referred to <br />motorcycle ride on August 31, 2003, beginning at 12:00 noon from the South Bend Airport. Upon <br />a motion made by Mr. Inks, seconded by Mr. Gilot and carried, the recommendation was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - FIRST <br />NORTH/SOUTH ALLEY WEST OF DALE <br />Mr. Gilot indicated that Mr. Michael Fine, 1014 East Bowman, South Bend, Indiana, has submitted <br />a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in receipt of <br />recommendations concerning this Vacation Petition from the Area Plan Commission, Police <br />Department, Fire Department, Sanitation, Department of Economic Development and the <br />Department of Public Works, as follows: Area Plan recommends this right-of-way be vacated, <br />subject to creating a cross -access easement for the neighbor to access his property and also subject <br />to any utility easements that may be required. Engineering concurs with the recommendation. <br />Therefore, Mr. Gilot made a motion that the Clerk send a letter to the petitioner addressing these <br />concerns. Mr. Littrell seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - FIRST <br />NORTH/SOUTH ALLEY EAST OF PARK AVENUE <br />Mr. Gilot indicated that Mr. Jerry Bickel, 417 West Navarre, South Bend, Indiana, has submitted a <br />request to vacate the above referred to alley. Mr. Gilot advised that the Board is in receipt of <br />recommendations concerning this Vacation Petition from the Area Plan Commission, Police <br />Department, Fire Department, Sanitation, Department of Economic Development and the <br />Department of Public Works, as follows: Area Plan does not recommend that this right of way be <br />vacated. Doing so would severely hinder access to property that has access on this alley. Creating <br />a dead-end alley is not encouraged, especially one that appears to be used on a regular basis. The <br />Fire Department and Engineering concur. Therefore, Mr. Gilot made a motion that the Clerk send <br />a letter to the petitioner addressing these concerns. Mr. Littrell seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - FIRST <br />NORTH/SOUTH ALLEY WEST OF COLFAX AVENUE <br />Mr. Gilot indicated that Mr. Melvin Wilson,1022 West Colfax, South Bend, Indiana, has submitted <br />a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in receipt of <br />recommendations concerning this Vacation Petition from the Area Plan Commission, Police <br />Department, Fire Department, Sanitation, Department of Economic Development and the <br />Department of Public Works, as follows: Area Plan recommends that this right-of-way be vacated, <br />subject to any utility access easements that may be necessary. The Fire Department stated that the <br />petitioner uses the alley for trash pick-up. Engineering stated that the alley creates a "T" intersection <br />of alleys to the south. Existing obstructions do not permit adequate turning radii to negotiate even <br />automobiles easily through he alley intersection. There is a garage at 1022 West Colfax that depends <br />on the alley for access. Cross -access easement will be necessary if the current common ownership <br />changes. The "other half' of the alley should be vacated to resolve the turning radius issue. <br />Therefore, Mr. Gilot made a motion that the Clerk send a letter to the petitioner addressing these <br />concerns. Mr. Littrell seconded the motion which carried. <br />
