<br />FAVORABLE RECOMMENDATION - PETITION TO VACATE STREETS - CIRCLE AVENUE
<br />FROM WASHINGTON TO PENN CENTRAL RAILROAD AND GRANT STREET FROM
<br />WASHINGTON TO PENN CENTRAL RAILROAD
<br />Mr. Littrell indicated that Mr. Mike Danch, Hurwich Iron, South Bend, Indiana, has submitted a
<br />request to vacate the above referred to streets. Mr. Gilot advised that the Board is in receipt of
<br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police
<br />Department, Fire Department, Sanitation, Department of Economic Development and the Department
<br />of Public Works. Engineering indicated a favorable recommendation provided the lots have common
<br />ownership and become platted to one parcel. The Grant Street vacation should be coordinated with
<br />the adjacent property owner. Community & Economic Development stated that the Circle Avenue
<br />vacation raises questions because of the proposed use and potential negative effects on the West
<br />Washington neighborhood due to noise, and provided a negative recommendation. Area Plan does
<br />not recommend that Grant Street be vacated because this would hinder access to properties along the
<br />right of way. The staff does not recommend Circle Avenue be vacated because this would completely
<br />take access away from an adjacent property. However, if the vacations are permitted, they do so
<br />subject to any access and utility easements that may be necessary. Therefore, Mr. Littrell made a
<br />motion that the Clerk send a letter to the petitioner addressing these concerns. Mr. Inks seconded the
<br />motion which carried.
<br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - ALLEY GOING
<br />EAST OFF OF 26TH STREET NORTH OF RAILROAD TRACK, AND ENDING
<br />APPROXIMATELY 141.6" EAST AT THE INTERSECTION OF ANOTHER ALLEY
<br />Mr. Littrell indicated that Mr. John Leader, 420 South 26t' Street, South Bend, Indiana, has submitted
<br />a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in receipt of
<br />favorable recommendations concerning this Vacation Petition from the Police Department, Fire
<br />Department, Sanitation, Department of Economic Development and the Department of Public Works.
<br />Area Plan does not recommend this alley be vacated. It appears to be a heavily used alley. If the
<br />vacation took place, it would hinder access to other properties in the neighborhood. Furthermore, it
<br />would also create excess in and out traffic on Jefferson Boulevard. Mr. Littrell made a motion that
<br />the Clerk send a letter to the petitioner addressing these concerns. Mr. Inks seconded the motion
<br />which carried.
<br />APPROVAL OF RECOMMENDATION - TO CONDUCT BIKE RODEO - NAPTOWN RIDERS
<br />Mr. Littrell stated that favorable recommendations have been received by Traffic and Lighting, Park
<br />Department, Police Department and the City Attorney's office, in reference to a request as submitted
<br />by Ms. Nikita Wyler, 609 Warren, South Bend, Indiana, to conduct the above referred to parade on
<br />August 23, 2003, from 12:00 pm. to 2:00 pm.., on the designated route as submitted. Upon a motion
<br />made by Mr. Littrell, seconded by Mr. Inks and carried, the recommendation was approved.
<br />APPROVAL OF RECOMMENDATION - TO CLOSE STREET - NORTH MAIN FROM COLFAX
<br />TO WASHINGTON - AERIAL FIREWORKS DISPLAY - DOWNTOWN SOUTH BEND INC.
<br />Mr. Littrell stated that favorable recommendations have been received by Traffic and Lighting, Park
<br />Department, Police Department and the City Attorney's office, in reference to a request as submitted
<br />by Ms. Shannan Schmidt, Downtown South Bend, Inc., 205 North Main, South Bend, Indiana to
<br />conduct the above referred to fireworks display on August 8, 2003, from 9:30 p.m. to 9:45 p.m. Upon
<br />a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the recommendation was approved,
<br />subject to approval from the State Highway to close North Main.
<br />APPROVAL OF RECOMMENDATION - TO CLOSE STREET - CHAPIN FROM CALVERT TO
<br />BRUCE - OUR LADY OF HUNGARY PARISH FESTIVAL
<br />Mr. Littrell stated that favorable recommendations have been received by Traffic and Lighting, Police
<br />Department and the City Attorney's office, in reference to a request as submitted by Ms. Denise
<br />Domonkos, Our Lady of Hungary Parish, 920 West Calvert, South Bend, Indiana, to conduct the
<br />above referred to event on July 19, 2003, from 4:00 p.m. to 10:00 p.m. Upon a motion made by Mr.
<br />Littrell, seconded by Mr. Inks and carried, the recommendation was approved.
