Therefore, Mr. Gilot made a motion to approved the request for this alley <br />vacation, subject to addressing the above referred to concerns. Mr. Littrell seconded the motion <br />which carried. The Clerk will forward all comments and concerns to the petitioner for further action <br />with the Common Council. <br />FAVORABLE RECOMMENDATION - TO VACATE AN ALLEY - NORTH/SOUTH ALLEY <br />BOUNDED BY BERGAN/MEADE/HAMILTON AND KALEY STREETS <br />Mr. Gilot indicated that Mr. Lee Helmlinger, 1333 Climbing Rose Lane, Mishawaka, Indiana, has <br />submitted to the Board a request to vacate the above referred to alley. Mr. Gilot advised that the <br />Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area <br />Plan Commission, Police Department, Fire Department, Sanitation, and the Department of Public <br />Works. Community and Economic Development forwarded an unfavorable recommendation, <br />stating that it appears the vacation would create a dead-end alley. However if all the lots in the block <br />are owned by the same person, then the recommendation would be favorable. Area Plan stated that <br />if this alley is vacated, that it be done so subject to the creation utility easements that may be <br />necessary. Also, it is not know whether the majority of the affected landowners have signed the <br />petition to vacate the alley. Therefore, Mr. Gilot made a motion to approved the request for this alley <br />vacation, subject to addressing the above referred to concerns. Mr. Littrell seconded the motion <br />which carried. The Clerk will forward all comments and concerns to the petitioner for further action <br />with the Common Council. <br />FAVORABLE RECOMMENDATION - TO VACATE CRESCENT AVENUE BETWEEN NILES <br />AND HILL STREET <br />Mr. Gilot indicated that Mr. Bill Schalliol, Community and Economic Development, has submitted <br />to the Board a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Police Department, Fire Department, Sanitation, and the Department of Public Works. <br />The Fire Department forwarded a favorable recommendation subject to the property owner at 411 <br />Lincolnway West having no objections. Community and Economic Development. Engineering <br />stated that a utility easement release would be contingent on future consideration in favor of the City <br />for a new storm sewer easement. Area Plan noted that it appeared that one property has access from <br />Crescent Avenue and would be hindered by the vacation. If the street is vacated, it should be done <br />so subject to the creation of utility easement for cross access easement that may be necessary. <br />Therefore, Mr. Gilot made a motion to approved the request for this alley vacation, subject to <br />addressing the above referred to concerns. Mr. Littrell seconded the motion which carried. The <br />Cleric will forward all comments and concerns to the petitioner for further action with the Common <br />Council. <br />APPROVAL OF RECOMMENDATION - TO CLOSE STREET - GARDEN PLACE TO NORTH <br />ALBERT (CUL-DE-SAC) - WEDDING/RECEPTION <br />Mr. Gilot stated that favorable recommendations have been received by Traffic & Lighting, Police <br />Department and the City Attorney's office, in reference to a request as submitted by Ms. Christie <br />Simpson, 4007 Garden Place, South Bend, Indiana, to conduct the above referred to event on May <br />24, 2003, from 12:00 p.m. until 9:00 p.m. Upon a motion made by Mr. Littrell, seconded by Mr. <br />Gilot and carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br />INSTALLATION OF AWNING - 115 WEST COLFAX <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations from the Division of <br />Engineering, Police Department, Building Commissioner and the Fire Department for the installation <br />of an awning at 115 West Colfax Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and <br />carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO CLOSE STREET - THOMAS FROM <br />MCPHERSON TO LAUREL AND MCPHERSON FROM THOMAS TO NAPIER - FINAL HOLY <br />MASS FOR ST. STEPHENS CHURCH <br />Mr. Gilot stated that favorable recommendations have been received by Traffic & Lighting, Police <br />Department and the City Attorney's office, in reference to a request as submitted by Mr. Jose <br />
