006 <br />REGULAR MEETING MARCH 10, 2003 <br />APPROVAL OF RECOMMENDATION - TO CONDUCT ALZHEIMER'S WALK <br />Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting, Park <br />Department, Police Department and the City Attorney's office, in reference to a request as submitted <br />by Mr. William Jack, Alzheimer's Services,108 North Main Street, South Bend, Indiana to conduct <br />the above referred to walk on September 13, 2003 beginning at 8:30 a.m. on the designated route as <br />submitted. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the <br />recommendation was approved. <br />FAVORABLE RECOMMENDATION -PETITION TO VACATE AN ALLEY NEAR 500 BLOCK <br />EAST INDIANA <br />Mr. Gilot indicated that Mr. Brian Zbrzezny, 514 East Indiana, South Bend, Indiana, has requested <br />to vacate the above referred to alley. <br />The Division of Engineering stated that the garage on Lot 5 requires access from the proposed <br />vacated alley. Currently Lots 4 and 5 have common ownership and the garage is proposed for <br />demolition. The proposed vacation creates a "T" alley which is only one (1) lot deep. Reverse <br />movements for large vehicles to exit are not objectionable. The Fire Department stated that the <br />resident at 518 will not have access to their garage. Area Plan recommends that if the alley is <br />vacated, that it be done so subject to the creation of a cross -access easement and any utility <br />easements that may be necessary. Therefore, Mr. Gilot made a motion to approve this Vacation <br />Petition. Mr. Littrell seconded the motion which carried. The Clerk of the Board will forward a <br />letter to the petitioner with recommendations and/or concerns. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY NEAR THE 1200 <br />BLOCK OF THOMAS STREET <br />Mr. Gilot indicated that Mr. David Stevens,1217 Thomas Street, South Bend, Indiana, has submitted <br />a request to vacate the above referred to alley. <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. The Division of <br />Engineering and Area Plan recommends that if the alley is vacated, that it be done so subject to the <br />creation of a cross -access easement and any utility easements that may be necessary. Therefore, Mr. <br />Littrell made a motion that the Board send a favorable recommendation to approve this request. Mr. <br />Gilot seconded the motion which carried. The Clerk of the Board will forward a letter to the <br />petitioner with recommendations and/or concerns. <br />ADOPT RESOLUTION NO. 20-2003 - DISPOSAL OF CITY OWNED PROPERTY <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO.20-2003 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January <br />11, 1988, Ordinance No. 7847-88 which mandates the Board of Public Works of the City of South <br />Bend to determine that the sidearm of a police officer who retires in good standing is surplus <br />property and no longer useful to the City of South Bend; and <br />WHEREAS, SERGEANT TERRY ALLEN retired from the South Bend Police Department <br />after twenty (20) years of service and the Board of Public Safety of the City of South Bend has <br />determined that he has retired in good standing; and <br />WHEREAS, I.C. 5-22-22-1 permits and establishes procedure for disposal of personal <br />property which is no longer needed by the City and which is unfit for the purpose for which it was <br />intended; <br />
